Frente ao panorama de constante crise das instituições de controle social formal, uma adequada compreensão do funcionamento do sistema penal demanda que os mecanismos de reação social sejam efetivamente investigados e deslindados. Afinal, somente por meio de sua intervenção, as situações e comportamentos sociais passam a ser propriamente considerados criminais e dignos de reprovação jurídico-social. Seriam eles que determinariam as consequências decorrentes dessa atribuição de predicados e provocariam enorme impacto na vida de todos os seus envolvidos. Desse modo, diante da questão sobre como a criminalidade emerge e se inscreve no interior da vida social, o presente livro busca explorar os fundamentos de teorias que explicitariam os processos de atribuição de rótulos criminais e a dinâmica dos conflitos existentes na criação das normas penais e seu respectivo processo de aplicação. O interacionismo simbólico, com a perspectiva do etiquetamento, e a sociologia do conflito, com sua analítica do poder, forneceriam os pressupostos mais sólidos para se compreender o processo de criminalização que se opera no interior da sociedade e do aparato penal, em particular. Trazer à tona esses mecanismos de interação e dispositivos de poder permitiria, assim, um desnudamento das práticas e discursos que se configuram ao redor do crime e do criminoso. Com base nessas premissas, seria possível desvendar os desafios de conformação do arcabouço penal e do contínuo processo de seletividade de sua atuação. O escopo dessa obra, portanto, seria iluminar aspectos teóricos que, consagrados na criminologia e sociologia do crime, possibilitariam um enfoque mais atento sobre as raízes dos problemas do sistema penal e sua insidiosa forma de operação.
