Il libro esamina le importanti novità che si sono avute a proposito della disciplina penale degli stupefacenti, anche alla luce delle esperienze di altri Paesi. Tutto ha avuto origine dalla sentenza costituzionale n. 32 del 2014, che ha dichiarato l’illegittimità della legge “Fini-Giovanardi” del 2006 la quale aveva equiparato sotto il profilo sanzionatorio le droghe “leggere” a quelle “pesanti”, ripristinando la previgente disciplina abrogata. Problemi si sono posti soprattutto con riferimento agli effetti della declaratoria d’incostituzionalità di una norma penale “non incriminatrice”, poiché la sentenza n. 32/2014 ha annullato norme che disciplinavano il trattamento sanzionatorio e non già norme incriminatrici. Il sistema degli stupefacenti è stato inoltre profondamente innovato con la trasformazione della circostanza attenuante del “fatto di lieve entità” in ipotesi autonoma di reato. Il quadro normativo è stato poi modificato a seguito dell’emanazione del d.l. n. 36 del 2014 (che ha reintrodotto nelle tabelle le circa 500 droghe venute meno per effetto della sentenza n. 32/2014), e della l. n. 242 del 2016 che ha reso lecita la coltivazione della cannabis sativa L. Il lavoro nella parte conclusiva analizza la normativa sovranazionale: la Convenzione sugli stupefacenti di New York del 1961, la Convenzione sulle sostanze psicotrope di Vienna del 1971, la Convenzione delle Nazioni Unite contro il traffico di stupefacenti di Vienna del 1988 e la decisione-quadro del Consiglio dell’Unione Europea del 2004. L’analisi ha permesso di verificare le limitazioni poste dagli atti internazionali al legislatore italiano, anche con riferimento all’eventuale legalizzazione dell’uso personale della cannabis.

«Pendono interrotte le opere…», recita un celebre verso nel quarto libro dell’Eneide, quando a Cartagine, in conseguenza della passione di Didone per Enea, il fervore dei cantieri, si è improvvisamente fermato. In età contemporanea l’incompiuto, oltre che nelle arti figurative e in letteratura, suscita molto interesse nel campo dell’architettura, perché rappresentativo delle condizioni di provvisorietà e di precarietà del secolo da poco iniziato. Questo libro si concentra sulle cause e sulla percezione dei diversi monumenti incompiuti del mondo greco dall’età arcaica in poi ed esamina in dettaglio le vicende di alcuni edifici interrotti e/o contraddistinti dalla presenza di parti lasciate in diversi stadi di lavorazione e mai giunte alla fine (telos) grazie alle evidenze archeologiche, epigrafiche e letterarie. Risalenti ai tanti secoli compresi tra l’età arcaica e almeno la tarda epoca imperiale, quelle costruzioni sono ovunque e appartengono a una vasta area geografica, dalla Grecia continentale alla Magna Grecia e all’area microasiatica. Al centro dell’interesse è quindi quanto in architettura poteva valere come atelēs, hēmitelēs, hēmiergos, inchoatus, imperfectus; tutti vocaboli che traduciamo, in modo più approssimativo, con aggettivi privativi del genere di non finito, non rifinito, incompiuto, incompleto, interrotto e imperfetto, spesso impiegati come sinonimi; ma non è poi detto che tutto quello che abbiamo la tendenza oggi a considerare tale fosse giudicato in maniera analoga dagli Antichi.

Questione assai spinosa per gli specialisti della lirica antico-francese, il cui corpus è costituito da oltre 2.500 componimenti, è quella della paternità: il 63% dei testi è anonimo; dei rimanenti, nel 17% dei casi le rubriche dei canzonieri propongono almeno due autori. Il fenomeno delle attribuzioni discordanti, di vasta portata, non è però evidenziato a sufficienza nei repertori attualmente disponibili: in questo studio si tenta di sondarne le principali casistiche e si propone, inoltre, una schedatura dei trovieri il più possibile neutra e non viziata da giudizi precostituiti. In ultima analisi, l’escursione attributiva non sembrerebbe solo un problema ecdotico, ma anche e soprattutto la testimonianza di una vitalità letteraria.

This book arises from a three-year study of Preventive Justice directed by Professor Andrew Ashworth and Professor Lucia Zedner at the University of Oxford. The study seeks to develop an account of the principles and values that should guide and limit the state's use of preventive techniques that involve coercion against the individual. States today are increasingly using criminal law or criminal law-like tools to try to prevent or reduce the risk of anticipated future harm. Such measures include criminalizing conduct at an early stage in order to allow authorities to intervene; incapacitating suspected future wrongdoers; and imposing extended sentences or indefinate on past wrongdoers on the basis of their predicted future conduct - all in the name of public protection and security. The chief justification for the state's use of coercion is protecting the public from harm. Although the rationales and justifications of state punishment have been explored extensively, the scope, limits and principles of preventive justice have attracted little doctrinal or conceptual analysis. This book re-assesses the foundations for the range of coercive measures that states now take in the name of prevention and public protection, focussing particularly on coercive measures involving deprivation of liberty. It examines whether these measures are justified, whether they distort the proper boundaries between criminal and civil law, or whether they signal a larger change in the architecture of security. In so doing, it sets out to establish a framework for what we call 'Preventive Justice'.
