A series of humanitarian tragedies in the 1990s (Somalia, Rwanda, Srebrenica, Kosovo) demonstrated the international community's failure to protect civilians in the context of complex emergencies. They were the inspiration for two norms of protection, Responsibility to Protect (R2P) and Protection of Civilians (POC), both deeply rooted in the empathy that human beings have for the suffering of innocent people. Both norms have achieved high-level endorsement: R2P from the 2005 World Summit and its Outcome document (Art. 138-140) and POC from a series of Security Council resolutions. The two norms of protection were instrumental in adopting the Security Council Resolutions 1970 and 1973 (Libya) and 1975 (Cote d'Ivoire) in the year 2011. Both norms raise concerns of misinterpretation and misuse. They both are developing--sometimes in parallel, sometimes diverging, and sometimes converging--with varying degrees of institutionalization and acceptance. This process is likely to continue for some time, with successes and failures enhancing or retarding that development. This book engages in a profound comparative analysis of the two norms and aims to serve policymakers at different levels (national, regional, and UN), practitioners with protective roles (force commanders, military trainers, strategists, and humanitarian actors), academics and researchers (in international relations, law, political theory, and ethics), civil society, and R2P and POC advocates.

This book explains why there is a pronounced disjuncture between R2P's habitual invocation and its actual influence, and why it will not make the transformative progress its proponents claim. Rather than disputing that R2P is a norm, or declaring that norms are insignificant, Hehir engages with post-positivist constructivist accounts on the role of norms to demonstrate first, that the efficacy of a norm is not directly related to the extent to which it is proliferated or invoked, and second, that in the post-institutionalization phase, norms undergo both contestation and (potentially regressive) reinterpretation. This volume analyses the evolution of R2P, and demonstrates that it has been steadily circumscribed and co-opted, so that today it has no power to meaningfully influence the behaviour of states. It is essential reading for academic audiences in the disciplines of International Relations and International Law.

This book explores how the bedrock institution of today’s global order – sovereignty – is undergoing transformation as a result of complex interactions between power and norms, between politics and international law. This book analyses a series of controversial military interventions into the internal affairs of "irresponsible sovereigns" and discusses their consequences for the rules on the use of force and the principle of sovereign equality. Featuring case studies on Kosovo, Darfur and Afghanistan, It shows that frames from one discourse (for example the debate over the responsibility to protect) have been imported into other discourses (on counter-terrorism and nuclear non-proliferation) in an attempt to legitimize a bold challenge to the global legal order. Although the ‘demise’ of sovereignty is widely debated, this book instead seeks to ‘deconstruct’ sovereignty by explaining how this institution has been reconstituted by global powers whose hegemonic law-making activities have popularized the notion of sovereignty as responsibility. ‘Responsibility to Protect and Prevent: Principles, Promises and Practicalities’ explores the evolution of responsibility to protect (R2P), a principle which – according to its supporters – has evolved into a new type of responsive norm for how the international community should react to serious and deliberate human rights violations. Arguing that the R2P ethos has been misunderstood and used ineffectively, this work defends the validity of R2P and urges for a more practical understanding that moves beyond theory. The progression of R2P from an initial concept to formal ratification has been a very difficult one, with a great deal of disagreement over its validity as a substantive norm in international affairs. The key disagreement is not that protection or prevention are unimportant, but rather how the fine-sounding R2P principles are supposed to work in practice. This volume presents a number of important arguments that are directly related to the state vs. human security debate, with a critical analysis of the nexus between the protection verses prevention theses. This edited volume critically examines the Responsibility to Protect (R2P) as a guiding norm in international politics. After NATO’s intervention in Libya, against the backdrop of civil wars in Syria and Yemen, and because of the cynical support for R2P by states such as Saudi Arabia, this norm is the subject of heavy criticism. It seems that the R2P is just political rhetoric, an instrument exploited by the powerful states. Hence, the R2P is being challenged. At the same time, however, institutional settings, normative discourses and contestation practices are making it more robust. New understandings of responsibility and the politics of protection are creating new normative spaces, patterns of legitimacy, and norm entrepreneurs, thereby reinforcing the R2P. This book’s goals are to discuss the R2P’s roots, institutional framework, and evolution; to reveal its shortcomings and pitfalls; and to explore how it is exploited by certain states. Further, it elaborates on the R2P’s strength as a norm. Accordingly, the contributions presented here discuss various ways in which the R2P is being challenged or confirmed, or both at once. As the authors demonstrate, these developments concern not only diplomatic communication and political practices within international institutions, but also to normative discourses. Furthermore, the book includes chapters that reevaluate the R2P from a normative standpoint, e.g. by proposing cosmopolitan standards as a guide for states’ external behavior. Other contributors reassess the historical evidence from U.N. negotiations on the R2P principle, and the productive or restrictive role of institutions. The human rights and humanitarian landscape of the modern era has been littered with acts that have shocked the moral conscience of mankind, and there has been wide variation in whether, how, and to what degree states respond to mass atrocity crimes, even when they share similar characteristics. In many cases concerned states responded, either through moral suasion; gentle or coercive diplomacy; or other non-forcible measures, to prevent or halt the indiscriminate human rights violations that were occurring. In others, states simply turned away and left the vulnerable to their fate. And still yet in other cases, states responded robustly, using military force to stop the atrocities and save lives. This book seeks to examine the effects of strategic framing in U.S. and UN policy arenas to draw conclusions regarding whether and how the human rights and humanitarian norms embedded within such frames resonated with decision-makers and, in turn, how they shaped variation in levels of political will concerning humanitarian intervention in three cases that today would qualify as Responsibility to Protect (R2P) cases: Somalia, Rwanda, and Sierra Leone. Labonte concludes that in order for humanitarian interventions to stand a higher likelihood of being effective, states advocating in support of such actions must find a way to persuade policymakers by appealing to both the logic of consequences (which rely on material and pragmatic considerations) and logic of appropriateness (which rely on normatively appropriate considerations) – and strategic framing may be one path to achieve this outcome. Offering a detailed and examination of three key cases and providing some an original and important contribution to the field this work will be of great interest to students and scholars alike.
