This Guide is not only easy to navigate, but also simple to understand. It will be welcomed by law professors and novice appellate attorneys all over North Carolina as a thorough, practical instruction manual on how to file or respond to an appeal in accordance with the Rules of Appellate Procedure. Existing texts are designed primarily to be a universal guide on persuasive writing and advocacy but lack specific references to the local requirements and corresponding North Carolina court decisions on this topic. Professor Williams has drawn on her extensive experience and anticipated questions that may be asked by a student or advocate of appellate law. Corresponding case references provide the reader with context. An extra tool is a thorough appendix with superb examples of appellate documents. This book is a must-have for any practicing, studying and/or interested in appellate law!

Relief From Judgment In North Carolina Civil Cases written by Ann M. Anderson and has been published by Unc School of Government this book supported file pdf, txt, epub, kindle and other format this book has been release on 2016 with Law categories.

A party to a civil action may seek relief from a final judgment or order of North Carolina's trial courts for many reasons. Litigants often take their arguments to the state's appellate division. But for many issues, the North Carolina Rules of Civil Procedure provide methods for first seeking relief directly from the trial courts themselves. These rules, presented in Chapter 1A of the North Carolina General Statutes, and North Carolina case law interpreting them, are the focus of this book. The discussion proceeds in two parts. -Part One covers motions for immediate post-trial relief. -Part Two covers motions brought under Rule 60(b), which allows relief from a "final judgment, order, or proceeding" based on any of six specific grounds that are based largely in equity, and, in general, are discretionary. The book concentrates on North Carolina case law, primarily cases that interpret the Rules of Civil Procedure governing these motions rather than cases discussing the common law upon which the rules are based or statutes that preceded them. North Carolina Civil Trial Practice written by G. Nicholas Herman and has been published by Juris Publishing, Inc. this book supported file pdf, txt, epub, kindle and other format this book has been release on 2014-09-01 with Court rules categories.

North Carolina Civil Trial Practice is North Carolina's only and leading practitioner treatise on civil trial practice and procedure (with application of the N.C. Rules of Evidence). There are a number of books for practitioners in North Carolina in various, distinct subjects (e.g. in torts, workers' compensation, real property law, family law, North Carolina corporations, North Carolina evidence, Employment Law and North Carolina Criminal Procedure). However, there is currently no civil trial practice book available in North Carolina; and this work fills that gap and is designed to be used by all civil trial lawyers in North Carolina, whether plaintiff or defense-oriented. North Carolina Civil Trial Practice comprehensively covers (1) the procedural, and (2) substantive law of, and (3) practice techniques for the trial of any North Carolina civil case -- from pre-trial procedure, mediation, and all stages of a trial (jury selection, open statement, direct and cross-examination, the jury charge conference, and closing argument). In addition, the book covers a detailed application of the North Carolina Rules of Evidence as they relate to the foregoing and to making objections and offers of proof, conducting direct and cross-examinations (including impeachment and rebuttal), introducing exhibits, and preserving the record for appeal. No current book in North Carolina addresses these matters. The book is thus distinct from any other North Carolina practitioner treatise, and is designed (1) as the definitive resource for civil practitioners preparing for any trial (bench trial or jury trial in any civil proceeding ) and (2) for ready use in court when counsel needs to quickly find out how to introduce a particular matter or item of evidence at trial or otherwise how to deal with any other matter occurring at trial. In sum, North Carolina Civil Trial Practice is the standard "bible" for all civil trial practitioners.
