SOBRE A OBRA “A Lei 14.026, de 15.07.2020, atualizou o Marco Regulatório do Saneamento Básico no país, instituído pela Lei 11.445/2007, que dispõe sobre as Diretrizes Nacionais para o Saneamento Básico. Para ajustar essa alteração ao ordenamento jurídico, introduziu modificações na Lei 9.884/2000, de 17.07.2000, para atribuir à Agência Nacional de Águas e Saneamento Básico (ANA) competência para instituir normas de referência para a regulação dos serviços públicos de saneamento básico; na Lei 10.768, de 19.11.2003, para alterar o nome e as atribuições do cargo de Especialista em Recursos Hídricos; na Lei 11.107, de 06.04.2005, para vedar a prestação por contrato de programa dos serviços públicos de que trata o art. 175 da Constituição Federal; na Lei 12.305, de 02.08.2010, para tratar de prazos para a disposição final ambientalmente adequada dos rejeitos; na Lei 13.089, de 12.01.2015 (Estatuto da Metrópole), para estender seu âmbito de aplicação a unidades regionais e a Lei 13.529, de 04.12.2017, para autorizar a União a participar de fundo com a finalidade exclusiva de financiar serviços técnicos especializados. A estrutura normativa brasileira, dessa forma, foi aprimorada, com vistas a equacionar gargalos existentes na legislação sobre saneamento básico, e que se referem, precipuamente, aos seguintes fatos: 1. No Brasil, até a edição da Lei 14.026/2020, 5.570 municípios, nas mais variadas situações econômicas, financeiras, sociais, geográficas, hidrológicas e ambientais, vêm exercendo a titularidade dos serviços de saneamento básico: abastecimento de água potável, esgotamento sanitário, manejo de resíduos sólidos urbanos e drenagem urbana. O sucesso do exercício dessa titularidade, todavia, condiciona-se à existência de uma estrutura técnica e financeira para fazer frente aos desafios impostos pelo saneamento básico. 2. Essa diversidade e dificuldades ensejam um olhar não tão pulverizado, mas a partir de uma instância de caráter nacional, capaz de trazer para um determinado núcleo os grandes temas relacionados com esses serviços. Na legislação vigente essa atribuição coube à Agência Nacional de Águas e Saneamento Básico, para estabelecer normas de referência. 3. Dados recentes compilados pela Agência Nacional de Águas e Saneamento Básico apontam a existência de 72 (setenta e duas) agências reguladoras de saneamento básico no Brasil, sendo: 24 (vinte e quatro) agências estaduais, 1 agência distrital, 34 (trinta e quatro) agências municipais e 13 (treze) agências intermunicipais (consórcios públicos). O número continua em franca expansão e critérios de governança e padrões de sustentabilidade econômica dessas entidades não têm sido discutidos. 4. Outro ponto atacado pela nova Lei diz respeito à universalização da regulação, obrigando todos os municípios, em todos os componentes de saneamento básico, a indicarem uma agência reguladora para fiscalização dos serviços. Com mais de uma década da Política Nacional de Saneamento Básico, ainda temos mais de 1.800 municípios sem regulação, o que pressupõe a continuidade do modelo anterior à lei e tão atacado, tarifas sem critérios técnicos, falta de metas para investimentos e fiscalização precária dos serviços. 5. Embora o Brasil represente a nona economia do mundo, é necessário investir em saneamento básico. Com as seguidas crises econ6omicas que o país vem enfrentando, as perspectivas de avanço nesse setor não se mostram promissoras. Por essa razão, entre outras, a tendência da norma é abrir caminho para as concessões privadas, viabilizando maiores investimentos. Nesse cenário, vislumbramos a oportunidade de tratar das alterações havidas no Marco do Saneamento Básico, apresentando um conjunto de textos que tratam dos temas mais nevrálgicos, apontando os aspectos legais e de efetividade da nova norma”.
