El apoyo de la Blockchain a la actividad contractual dificulta la aplicación de la nulidad absoluta por objeto ilícito como siempre ha sido definida: como un supuesto de ineficacia por invalidez. Lo anterior ocurre al impedirse: (i) determinar la ley aplicable, debido a la descentralización de la Blockchain; (ii) identificar a las partes, en razón a su pseudoanonimato; (iii) interpretar el contenido del contrato, por la tecnificación del lenguaje; (iv) suprimir los efectos del contrato, por la irreversibilidad de la transacción. La presente investigación busca explorar las premisas del problema identificado con el fin de presentar soluciones concretas. Con este fin, se definirá al Smart-Contract como un medio de expresión de un contrato ordinario; lo anterior, advirtiendo que las normas que disciplinan su formación, si bien son válidas, no son eficaces en la Blockchain. Así, la relación entre la Blockchain y la actividad contractual se enmarca en un dilema entre validez y eficacia que impide que las soluciones tradicionales puedan utilizarse sin considerar el ambiente técnico en el que deberían aplicarse. Para reconciliar la validez de las normas con su eficacia en la Blockchain, se argumentará que la solución exige una redefinición del concepto de nulidad absoluta que no someta la eficacia del remedio a la ineficacia del contrato viciado; además, se advertirá que es necesaria una institucionalización de baja intensidad de la Blockchain que le permita al Estado ofrecer su autoridad, ya no coactivamente, sino como un servicio alternativo, mucho más completo y dotado de certeza jurídica, para la protección de las expectativas normativas fundamentales asociadas al contrato como institución de forma ex ante o ex post. De lo que se trata es de resaltar que ni la regulación ni las reglas de la tecnología pueden ser inflexibles cuando de alcanzar una solución justa a una problemática asociada al contrato se trata. Tanto la tecnología como la autoridad del Estado deben graduar su injerencia en la actividad contractual para permitirle a los individuos satisfacer sus intereses sin que eso signifique una renuncia a los beneficios de la tecnología o las protecciones y garantías fundamentales asociadas con la regulación.
