The Vietnam War And International Law Volume 3 written by Richard A. Falk and has been published by Princeton University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2015-03-08 with Law categories.

Issues of the war that have provoked public controversy and legal debate over the last two years—the Cambodian invasion of May-June 1970, the disclosure in November 1969 of the My Lai massacre, and the question of war crimes—are the focus of Volume 3. As in the previous volumes, the Civil War Panel of the American Society of International Law has endeavored to select the most significant legal writing on the subject and to provide, to the extent possible, a balanced presentation of opposing points of view. Parts I and II deal directly with the Cambodian, My Lai, and war crimes debates. Related questions are treated in the rest of the volume: constitutional debate on the war; the distribution of functions among coordinate branches of the government; the legal status of the insurgent regime in the struggle for control of South Vietnam; prospects for settlement without a clear-cut victory; and Vietnam's role in general world order. The articles reflect the views of some forty contributors: among them, Jean Lacouture, Henry Kissinger, John Norton Moore, Quincy Wright, William H. Rhenquist, and Richard A. Falk. Originally published in 1972. The Princeton Legacy Library uses the latest print-on-demand technology to again make available previously out-of-print books from the distinguished backlist of Princeton University Press. These editions preserve the original texts of these important books while presenting them in durable paperback and hardcover editions. The Nuremberg Fallacy written by Eugene Davidson and has been published by University of Missouri Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 1998 with History categories.

Available for the first time in paperback, The Nuremberg Fallacy examines the inherent shortcomings of the Nuremberg "rules of war" and the War Crimes Tribunal's impossible expectations. In 1946, the Tribunal declared all aggressive war, war crimes, and crimes against humanity illegal. Yet the period since World War II has witnessed an unprecedented number of armed conflicts. In light of recent crises, including those in Rwanda, Bosnia and Serbia, and the Middle East, it is clear that the issues explored in The Nuremberg Fallacy are as relevant today as they were at the time of the book's first publication a quarter century ago. In this volume, Eugene Davidson continues his investigations begun in The Trial of the Germans (University of Missouri Press), which studied the Nuremberg trials themselves, by focusing on five major conflicts since the end of World War II: the Suez crisis of 1956; Algeria's war of independence; Israel's recurring (and ongoing) battles with its Arab neighbors, complicated and worsened by intervention of the superpowers; the wars in Southeast Asia; and the Soviet Union's suppression of Czechoslovakia and other border states of Eastern Europe. By exploring the roots and ramifications of these five conflicts, Davidson is able to chart the crosscurrents between large and small states, between individual nations and the United Nations, between the rules of Nuremberg and the significantly older rules of self- interest. The result is a thoughtful and thought-provoking study of the dynamics of war and peace in the post-Nuremberg world. The rules of war proclaimed at Nuremberg--observing the flag of truce, prohibiting attacks on surrendered enemies, treating prisoners of war and civilian populations humanely--have become virtually irrelevant in modern guerrilla warfare. If anything, Davidson suggests, conditions have actually become worse than they were before the Nuremberg War Crimes Tribunal. The continuing importance and relevance of The Nuremberg Fallacy is best summarized in the final sentences of Davidson's text: "The survival of a nation cannot be successfully entrusted to simplistic formulae or to principles that reflect unworkable doctrines. No computers have been programmed for the wisdom that remains essential for survival. People still have to provide that from their own inner and outer resources, no matter how far the weapons may seem to have outdistanced them."

Number One Realist written by Nathaniel L. Moir and has been published by Oxford University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2022-04-01 with Political Science categories.

In a 1965 letter to Newsweek, French writer and academic Bernard Fall (1926-67) staked a claim as the 'Number One Realist' on the Vietnam War. This is the first book to study the thought of this overlooked figure, one of the most important experts on counterinsurgency warfare in Indochina. Nathaniel L. Moir's intellectual history analyses Fall's formative experiences: his service in the French underground and army during the Second World War; his father's execution by the Germans and his mother's murder in Auschwitz; and his work as a research analyst at the Nuremberg Trials. Moir demonstrates how these critical events shaped Fall's trenchant analysis of Viet Minh-led revolutionary warfare during the French-Indochina War and the early Vietnam War. In the years before conventional American intervention in 1965, Fall argued that--far more than anything in the United States' military arsenal--resolving conflict in Vietnam would require political strength, willpower, integrity and skill. Number One Realist illuminates Fall's study of political reconciliation in Indochina, while showing how his profound, humanitarian critique of war continues to echo in the endless conflicts of the present. It will challenge and change the way we think about the Vietnam War.
