This present book examines some of the key features of the interplay between legal history, authoritarian rule and political transitions in Brazil and other countries from the end of 20th Century until today. This book casts light on these aspects of the role of law and legal actors/institutions. In the context of transition from authoritarian rule to democratic state, Brazil has produced a significant literature on the challenges and shortcomings of the transition, but little attention has been given to the role of law and legal actors/institutions. Different approaches focus on the legal mechanisms, discourses and practices used by the military regime and by the players involved in the political transition process in Brazil. A comparative perspective that takes into account different political transitions – and their legal consequences – in Europe and Latin America complements the analysis. Part 1 (4 essays) discusses some of the central issues of political transition and legal history in contemporary Brazil, focusing on the time of the transition (and its effects on transitional justice) with different perspectives, from racial and gender issues to constitutional reform and police repression. Part 2 (3 essays) brings the comparative studies on South American experiences. Part 3 (4 essays) analyses different cases of transition to democracy in Chile, Portugal, Spain and Italy. Part 4 (3 essays) proposes a historiographical and methodological approach, considering the politics of time involved in the interplay between political transitions and legal history.

The United States has often acted as an empire in Latin America. Nevertheless, there has been an obvious dissimilarity between U.S. actions in South America and U.S. actions in the rest of Latin America, which is illustrated by the fact that the United States never sent troops to invade a South American country. While geographic distance and strategic considerations may have played a role, they provide at best incomplete explanations for the U.S.’s relative absence south of Panama. The fact that the United States has had a distinct pattern of interactions with South America is thus not captured by the typical concept of Latin America. In Brazil, the United States, and the South American Subsystem: Regional Politics and the Absent Empire, Carlos Gustavo Poggio Teixeira recuperates the virtually neglected literature on regional subsystems. In so doing, Teixeira maintains that researchers of inter-American relations would greatly benefit from a characterization reflecting actual regional realities more than entrenched preconceptions. Such a characterization involves subdividing the Western Hemisphere in two regional subsystems: North and South America. This subdivision allows for uncovering regional dynamics that can help explain the U.S.’s limited interference in South American affairs compared to the rest of Latin America. This book argues that the role of Brazil as a status quo regional power in South America is the key to understanding this phenomenon. Through a historical analysis focusing on specific cases spanning three centuries, this research demonstrates that Brazil, regardless of particular domestic settings, has deliberately affected the calculations of costs and benefits of a more significant US involvement in South America. While in the past Brazil has taken actions that resulted in increasing the benefits of the U.S.’s limited involvement in South America, in more recent times it has sought to increase the costs of a more significant U.S. presence. Teixeira then considers some of the theoretical and political implications of the framework laid out by this research. Brazil, the United States, and the South American Subsystem is a groundbreaking investigation of U.S.-Latin American relations and the politics of imperialism.

This book investigates how non-state actors have become key drivers of the diffusion of the UN 2030 Agenda for Sustainable Development in Brazil. The UN ranks Brazil as the most biodiverse country in the world, but the country’s environment has never been under greater threat, with the rise of multiple crises bringing mounting challenges to socioeconomic development and environmental protection. As state support has fallen away, non-state actors have actively engaged and eventually mobilized other social actors towards the promotion of the SDGs and the implementation of the UN agenda. This book asks why it is that non-state actors have dedicated so much time, effort and resources to promote a non-binding agenda that was ratified by and is mainly assigned to state actors. Looking at the roles of academia, civil society, and the private sector, the book explores the different ways in which these social actors make sense of and translate the 2030 Agenda into practice within their respective local contexts. Drawing on extensive fieldwork, this book sheds light on a series of challenges, opportunities and contradictions within the global agenda and its implementation. Assessing what the Brazil case can teach us about the diffusion of the 2030 Agenda and the SDGs more broadly, this book will be of interest to academics in the field of Sustainable Development, Latin America Studies and Environmental Politics as well as sustainable development researchers and policy makers.
