Este livro apresenta o exercício da liberdade de expressão como um dos fundamentos para o pleito eleitoral e como o fenômeno da Fake News foi apreciado pelo Tribunal Superior Eleitoral - TSE no que diz respeito à corrida presidencial de 2018 no Brasil. Para tanto, aprofunda-se as questões relacionadas às Fake News no processo eleitoral, identificando os fundamentos e os limites jurídicos à liberdade de expressão eleitoral. O problema de pesquisa foi saber de que maneira o TSE se posicionou diante das representações contra as Fake News. Para tanto, utilizou-se o método de abordagem da fenomenologia hermenêutica, tendo as Fake News como um fenômeno a ser entendido desde os aportes da democracia representativa, certame eleitoral e o legítimo exercício da liberdade de expressão. Também foi realizada pesquisa jurisprudencial no TSE para compreender o posicionamento do tribunal em representações contra Fake News.

Law, politics, and society in the modern West have been marked by the increasing power of the judge: the development of constitutional justice, the evolution of international judiciaries, and judicial systems that extend even further into social life.
