Neste processo, os direitos interno e o internacional terão de se comunicar e relacionar, o que – a histórica jurídica nos mostra – não é sempre pautado pela harmonia, mas sim por um embate de supremacias, vez que ambos buscam, no jogo da hierarquia das normas, se fazer um superior ao outro. Este embate de supremacias se faz sentir na ordem brasileira há tempos, não encontrando respostas normativas, mas apenas jurisprudenciais, ao exemplo da até hoje aplicada teoria da supralegalidade dos tratados de direitos humanos. Ocorre que desde a promulgação do Decreto n° 7.030/2009 – que internalizou a Convenção de Viena sobre Direito dos Tratados de 1969 – temos na ordem brasileira uma normativa que, ao que tudo indicada, delimita expressamente esta relação, resultando em profunda mudança no desenho hierárquico-normativo nacional. Essa regra é apresentada pelo art. 27° da citada Convenção. É pelo prisma do referido artigo que se propõe este livro a revisitar tão controvertida relação e elucidar se, de fato, estamos diante da formação de um novo desenho hierárquico no ordenamento jurídico nacional.
