Esta obra é fruto da dissertação apresentada como requisito parcial para a conclusão do Mestrado em Sistemas Jurídicos Contemporâneos na Faculdade de Direito – Departamento de Estudos Jurídicos Latino-Americanos, da Università Degli Studi di Roma Tor Vergata. Durante a realização das pesquisas e da escrita estive sob a cuidadosa e profícua orientação do Prof. Dr. Riccardo Cardilli e do Prof. Dr. Bruno Sassani. O Sistema de Precedentes Jurisdicionais é um tema ainda recente no Brasil, pois a formalização legal surgiu com o Código de Processo Civil de 2015. O tema da presente dissertação é a apresentação do sistema brasileiro de precedentes jurisdicionais com o objetivo de propor a sistematização dos precedentes ministeriais, assim entendidos como aqueles produzidos pelo Ministério Público em decorrência da sua atuação funcional, principalmente na tutela coletiva. Inicialmente foi apresentado o sistema jurídico do Direito Romano, pois é a origem remota dos sistemas jurídicos atuais, bem como explicitadas certas características da adoção de precedentes como reforço argumentativo na solução dos casos concretos. Foi imprescindível a realização, ainda que breve, de um esboço histórico do sistema jurídico do Direito Romano. para que pudesse ser contextualizado com os sistemas jurídicos contemporâneos. Os sistemas jurídicos contemporâneos foram apresentados em capítulo próprio, mas focado estritamente nas famílias de tradição jurídica da common law e civil law, suas influências recíprocas na formação dos demais sistemas e na teoria dos precedentes. Na parte final do presente trabalho foi examinada a possibilidade da atuação do Ministério Público, mediante o uso dos instrumentos extrajudiciais e extraprocessuais da tutela coletiva, ser considerada como um precedente ministerial para a solução dos casos concretos, futuros e semelhantes sob a sua responsabilidade. Foi apresentada a necessidade da sistematização dos precedentes ministeriais como forma de conferir maior unidade institucional, principalmente em temas mais relevantes, com a necessária mitigação do princípio da independência funcional. Conclui-se que os precedentes ministeriais devem ser considerados como orientações vinculantes e persuasivas, conforme o caso e o órgão de execução criador do mesmo.

Procedural law is no longer a purely domestic topic. The recent tendencies characterizing the field, such as Europeanization and harmonization, mark the evolution towards a new, cross-border dimension of this area of law.
