This book deals with the problem of human trafficking in Tanzania in the light of international law and considers human trafficking as both a criminal offence in Tanzania and a human rights violation within international law in general. The book broadens the reader’s understanding of the subject of human trafficking and Tanzania’s legal approach to the issue and allows the reader to grasp Tanzania’s anti-trafficking piecemeal efforts from the 1970s onwards, the reasons that made Tanzania ratify the Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children, supplementing the United Nations Convention against Transnational Organized Crime, and Tanzania’s National Assembly's deliberations regarding the enactment of the Anti-Trafficking in Persons Act of 2008 and the impact those deliberations have had on the current legal framework of Tanzania. It provides a firsthand critical analysis of the Tanzania anti-trafficking law, pointing out its strengths, weaknesses and areas for improvement in a comprehensive manner such as has never been attempted before. The book shares many tips and even insights on how to read and apply Tanzania’s 2015 Anti-Trafficking Regulations in relation to the main law harmoniously. It also offers complete instructions for common-law practitioners, court personnel, researchers and other anti-trafficking personnel on how to investigate and prosecute human trafficking, prevent trafficking, both lawfully and from occurring, as well as assist victims of human trafficking and protect their human rights. Nicksoni Filbert Kahimba is a doctoral researcher in the Faculty of Law of the Humboldt Universität zu Berlin in Berlin, Germany. The author also lectures at the School of Law of the University of Dar es Salaam in Tanzania. This edited collection analyses, from multiple disciplinary perspectives, the issue of corruption in commercial enterprise across different sectors and jurisdictions. Corruption is commonly recognised as a major ‘social bad’, and is seriously harmful to society, in terms of the functioning and legitimacy of political-economic systems, and the day-to-day lives of individuals. There is nothing novel about bribes in brown envelopes and dubious backroom deals, ostensibly to grease the wheels of business. Corrupt practices like these go to the very heart of illicit transacting in both legal markets – such as kickbacks to facilitate contracts in international commerce – and illegal markets – such as payoffs to public officials to turn a blind eye to cross-border smuggling. Aside from the apparent pervasiveness and longevity of corruption in commercial enterprise, there is now renewed policy and operational attention on the phenomenon, prompting and meriting deeper analysis. This book seeks to break new ground, both empirically and conceptually, in examining discourses of identity formation and the agency of critical social practices in Malaysia. Taking an inclusive cultural studies perspective, it questions the ideological narrative of ‘race’ and ‘ethnicity’ that dominates explanations of conflicts and cleavages in the Malaysian context. The contributions are organised in three broad themes. ‘Identities in Contestation: Borders, Complexities and Hybridities’ takes a range of empirical studies—literary translation, religion, gender, ethnicity, indigeneity and sexual orientation—to break down preconceived notions of fixed identities. This then opens up an examination of ‘Identities and Movements: Agency and Alternative Discourses’, in which contributors deal with counter-hegemonic social movements—of anti-racism, young people, environmentalism and independent publishing—that explicitly seek to open up greater critical, democratic space within the Malaysian polity. The third section, ‘Identities and Narratives: Culture and the Media’, then provides a close textual reading of some exemplars of new cultural and media practices found in oral testimonies, popular music, film, radio programming and storytelling who have consciously created bodies of work that question the dominant national narrative.
