Nearly every country in the world has a mechanism for executive clemency, which, though residual in most legal systems, serves as a vital due process safeguard and as an outlet for leniency in punishment. While the origins of clemency lie in the historical prerogative powers of once-absolute rulers, modern clemency laws and practices have evolved to be enormously varied. This volume brings comparative and empirical analysis to bear on executive clemency, building a sociological and political context around systematically-collected data on clemency laws, grants, and decision-making. Some jurisdictions have elaborate constitutional and legal structures for pardoning or commuting a sentence while virtually never doing so, while others have little formal process and yet grant clemency frequently. While the notion of 'Christmas pardons' has been around for some time, there has been almost no empirical research on whether federal executive clemency is in any way patterned in a manner that would legitimize the notion of 'Christmas' or even 'seasonal' pardons. Furthermore, previous research on clemency from 1789 to 1933 suggests the months of May and June have been the favored months when it comes to the granting of presidential pardons. This analysis explores 'seasonal clemency' in monthly data from January of 1931 to November of 2008. The 12 presidents covered have granted 10,626 individual pardons across 19 four year terms. The data show the largest number of pardons (2,453) has been granted in the month of December (more than two times the figure associated with the second highest month) and it is especially clear that more recent presidents (including George W. Bush) have skewed grants of clemency toward this part of the year. Having presented the data, some discussion is provided regarding possible explanations for these trends and troubling ramifications for federal executive clemency in the United States.

On January 11, 2003, prior to exiting office, Governor George Ryan of Illinois exercised his clemency authority and cleared the state of Illinois's entire death row by pardoning the sentences of four offenders and commuting the sentences of over 150 death row inmates. The blanket commutation of Governor Ryan is one of the most significant events surrounding the death penalty since the 1972 Supreme Court decision that ruled the death penalty unconstitutional. Although clemency is often an offender's final prospect to avoid execution within the death penalty context, prior research concerning clemency decisions remains limited by the fact that it is often atheoretical and researchers have used data more than a decade old. This study specifically placed clemency decisions within a focal concerns framework and examined death row inmates who were either executed or granted clemency between 1984 and 2008. This study used logistic regression as its primary modeling technique to examine whether measures for focal concerns theory were predictive of clemency decisions. While the current measures for offender blameworthiness and protection of the community were not found to influence clemency decisions, practical constraints and consequences measured by political factors and regional location along with offender characteristics were found to predict such decisions. Female offenders, non-white offenders, and offenders with lower educational levels were most likely to be granted clemency. Whereas lame duck governors were more likely to grant clemency, governors in southern states were less likely to grant clemency. The odds of clemency were reduced with each year an offender served.
