Los individuos del mundo contemporáneo nos sentimos más amenazados a morir que los individuos de épocas históricas pasadas. Se corren altos riesgos de morir por enfermedades terminales, por homicidio, accidentes de tránsito y aéreos, enfermedades cardíacas, accidentes de trabajo, contaminación ambiental, productos defectuosos, alimentos con alto contenido químico, como víctimas de la guerra, de la violencia o el narcotráfico. Más ciencia no ha significado más seguridad, más ciencia ha significado más riesgos e incertidumbres. Por eso se habla de la sociedad del riesgo: porque se articula alrededor de la protección y la seguridad, frente a la incertidumbre e inseguridad generada por los distintos riesgos creados por el hombre, a tal punto que se advierte un débil control sobre los mismos. En la sociedad del riesgo existe una relación de influencia entre el concepto de riesgo, el contexto actual de la sociedad del riesgo global y la imposibilidad e inaplicabilidad del concepto de responsabilidad en su forma más clásica, concretamente con la culpa. De esta manera, se advierte una marcada incidencia del riesgo en la Responsabilidad Civil y del Estado, toda vez que se constituye en criterio de imputación. Si los riesgos cambian o si se crean nuevos riesgos deben mutar las responsabilidades o adecuarse a los contextos y características contemporáneos; los dos pilares que sustentan la evolución de la responsabilidad son dinamismo y flexibilidad.

ACon este documento se busca hacer algunos aportes al análisis de los riesgos potenciales derivados de la introducción, el uso y la liberación al medio ambiente de los productos resultantes de la interacción o convergencia de las nano ciencias y las tecnologías del ADN recombinante o nuevas biotecnologías. El proceso de convergencia que se está llevando a cabo va mucho más allá del enfoque interdisciplinario o multidisciplinario de la investigación, pues al especializarse en el dominio a escala molecular, donde la materia, viviente o no, es prácticamente indistinguible, se puede integrar sin problemas. El reconocimiento del valor sinérgico de este proceso convergente ha dado origen al debate internacional, en donde se presentan las ventajas que permiten ampliar enormemente el conocimiento de la naturaleza, cuyos resultados constituyen una oportunidad para resolver problemas de la sociedad, pero también salen a flote temores sobre cómo este avance puede afectar profundamente a las economías nacionales, su comercio y los medios de vida, en especial la alimentación y la producción agrícola en los países tanto del Sur como del Norte.

La nanotecnologia (NT) representa una de las mas novedosas innovaciones cientificas, y en muchos sentidos, la de mayor alcance en lo referente a la alta tecnologia para la agricultura y los alimentos frescos. Se estima que en la actualidad en todo el mundo hay mas de 300 nanoproductos alimenticios disponibles en el mercado y se preve que para el 2015 la NT se utilizara en el 40% de las industrias alimentarias. Las nanoparticulas son de gran relevancia en la investigacion cientifica debido a que tienen una amplia variedad de aplicaciones potenciales en los campos biomedico, biologico, optico y electronico, entre otros. El uso principal de las NPs en la industria alimentaria se debe a su actividad antimicrobiana, por ejemplo el dioxido de titanio, es un colorante alimentario que puede utilizarse como barrera de proteccion en el envasado de alimentos o las NPs de plata utilizadas como agentes antimicrobianos en los paneles de los refrigeradores y frigorificos, asi como en los recipientes de almacenamiento, lineas de envasado y otras superficies destinadas a entrar en contacto con los alimentos.
