Esta obra recoge un profundo análisis de la realidad en cuanto a la pretendida libre circulación de pruebas en el ámbito de la Unión Europea. Se trata de un estudio analítico, siempre desde un punto de vista crítico y constructivo, que trata de contribuir a la mejora de la eficacia procesal de la prueba obtenida en un Estado miembro y empleada en procesos penales de otros países de la Unión. Este estudio se lleva a cabo desde diferentes perspectivas que comprenden el punto de vista legislativo, las diferentes posturas doctrinales, la jurisprudencia de los tribunales competentes y la experiencia acumulada en la aplicación de las herramientas. Con el fin de asegurar unas garantías mínimas de eficacia en las normas desarrolladas por la Unión Europea para la obtención de medios de prueba, en la obra se tratan de perfilar las herramientas de cooperación que están viendo la luz, así como de aportar cierto sustento, común y transversal, a los diferentes instrumentos de compartición de indicios ya existentes. Para esta aportación transversal, se apuesta por dar forma a unos estándares mínimos comunes que aseguren unos parámetros procesales similares en los diferentes Estados de la Unión Europea. Así, entre las propuestas más destacadas que recoge el texto, figura la creación de una Directiva Europea de Estándares Procesales que contribuya a homogeneizar el modo en que se llevan a cabo los actos de investigación en los diferentes Estados miembros. Como principio inspirador de esta Directiva, el autor establece el derecho a un proceso equitativo consagrado en el artículo 6.1 del Convenio Europeo de Derechos Humanos y en el artículo 47 de la Carta de Derechos Fundamentales de la Unión Europea. José Manuel Pérez Romero es comandante de la Guardia Civil, graduado en derecho y Doctor cum laude en Unión Europea por la UNED, realizando la mayoría de sus investigaciones en el ámbito de la cooperación procesal penal en el ámbito de la Unión. Ha realizado un Máster en Dirección y Gestión de la Seguridad (2011) por la Universidad Carlos III, un Máster en Seguridad (2015) por la UNED y un Máster en Política de Defensa y Seguridad Internacional (2018) por la Universidad Complutense de Madrid. Es diplomado en Estado Mayor y entre las unidades en las que ha estado destinado se encuentran la Jefatura de Información, la Academia de Oficiales y la Secretaría Técnica del Mando de Personal. Actualmente es agregado de interior en el Consulado General de España en Tánger, Reino de Marruecos.

With industrialization and globalization, corporations acquired the capacity to influence social life for good or for ill. Yet, corporations are not traditional objects of criminal law. Justified by notions of personal moral guilt, criminal norms have been judged inapplicable to fictional persons, who ‘think’ and ‘act’ through human beings. The expansion of new corporate criminal liability (CCL) laws since the mid-1990s challenges this assumption. Our volume surveys current practice on CCL in 15 civil and common law jurisdictions, exploring the legal conditions for liability, the principles and options for sanctioning, and the procedures for investigating, charging and trying corporate offenders.
