A partir des années soixante-dix, en France et dans d'autres Etats européens, les dispositions d'ordre public de protection du consommateur se multiplient. En droit international privé, à la protection de l'article 5 de la Convention de Rome du 19 juin 1980 sur la loi applicable aux obligations contractuelles entrée en vigueur en France le 1er avril 1991, s'est ajoutée récemment celle des directives communautaires relatives aux contrats conclus à distance, aux contrats de time-sharing et aux contrats comportant des clauses abusives, transposées en France dans les articles L. 135-1, L. 121-74, et L. 121-20-6 du Code de la consommation, et en Allemagne dans l'article 29a EGBGB. Au même moment, le groupe européen de droit international privé propose d'étendre le champ d'application de l'article 5. L'existence de ces différents textes tend à prouver que l'article 5 ne répond plus au besoin de protection du consommateur contemporain. La première partie de notre travail consiste à évaluer précisément les limites de cet article et nous proposons de le réactualiser en redéfinissant son champ d'application et en privilégiant la méthode comparative dans la détermination subjective et objective de la loi du contrat. Si l'article 5 est modifié, il est nécessaire d'étudier quels sont alors ses rapports avec l'exception d'ordre public et les lois de police. Nous constatons ainsi dans une seconde partie que l'exception d'ordre public de protection existe, mais qu'elle ne doit jouer que de manière exceptionnelle. Puis, après avoir également mis en évidence le particularisme des lois de police de protection, nous expliquons l'intérêt de leur utilisation. L'ensemble de cette étude permet d'apporter des solutions aux problèmes de la protection internationale du consommateur auxquels les tribunaux français seront bientôt confrontés et qu'une nouvelle version de l'article 5 devra impérativement résoudre.

Braithwaite's argument against punitive justice systems and for restorative justice systems establishes that there are good theoretical and empirical grounds for anticipating that well designed restorative justice processes will restore victims, offenders, and communities better than existing criminal justice practices. Counterintuitively, he also shows that a restorative justice system may deter, incapacitate, and rehabilitate more effectively than a punitive system. This is particularly true when the restorative justice system is embedded in a responsive regulatory framework that opts for deterrence only after restoration repeatedly fails, and incapacitation only after escalated deterrence fails. Braithwaite's empirical research demonstrates that active deterrence under the dynamic regulatory pyramid that is a hallmark of the restorative justice system he supports, is far more effective than the passive deterrence that is notable in the stricter "sentencing grid" of current criminal justice systems.
