Si l'analyse de la condition des étrangers est en général révélatrice du degré de tolérance d'une société, l'étude de leur statut en matière de droits sociaux permet quant à elle de souligner les limites et les paradoxes de l'Etat de droit. Parce que leur caractère " inaliénable et sacré " s'impose avec moins d'évidence, les droits sociaux consacrés par le Préambule de la Constitution de 1946, longtemps considérés comme l'accessoire des droits et libertés dits " classiques ", ont été d'autant moins facilement reconnus au profit des étrangers qu'ils ont des répercussions économiques et financières. Bon nombre d'entre eux étant, en outre, des " droits-créances ", imposant pour leur mise en oeuvre l'intervention du législateur, la condition des étrangers en la matière est longtemps restée subordonnée aux positions instables des majorités politiques. Aussi, loin d'être spontanée et immédiate, l'affirmation des droits sociaux des étrangers est, à l'image de l'ensemble du droit réservé à cette catégorie de personnes, le produit d'un long processus. Historiquement contesté, le droit des étrangers aux droits sociaux s'est néanmoins progressivement affirmé. Sous la pression des principes d'égalité et d'interdiction des discriminations reposant sur la nationalité, proclamés au niveau interne comme international, et grâce aux progrès des divers instruments de contrôle, l'accès des étrangers aux droits sociaux du Préambule a été admis. Pour autant, il n'est pas permis de parler d'identité de statut à l'égard des droits sociaux entre étrangers et nationaux. Résultante de l'immixtion de la politique d'immigration dans le secteur des droits de l'homme, la mise en oeuvre contemporaine des droits sociaux des étrangers apparaît encore largement contestable : la persistance de certaines discriminations reposant sur la nationalité ainsi que les conditions de l'accès de cette catégorie de personnes à ces droits témoignent en effet du caractère minimaliste du régime de droit commun. Bien que déjà ponctuellement assoupli, ce dernier est encore largement perfectible. Plusieurs évolutions récentes de la législation comme de la jurisprudence interne et internationale affectent les fondements de ces droits comme leur régime et semblent poser les bases d'une évolution favorable de la situation des non-nationaux à l'égard du bénéfice des droits sociaux.

Le droit de la famille, dans sa dimension civiliste, fortement ancré dans les cultures nationales des États membres, est une matière qui ne relève pas, en principe, du droit de l’Union européenne. Pourtant, il n’est plus possible d’affirmer que la matière échappe dans son entier au droit de l’Union. De nombreux aspects de la famille sont sous influence européenne, au point que l’on voit se dessiner les contours d’une « famille européenne ». L’ouvrage propose de mettre en lumière l’acquis européen en matière de droit de la famille, au prisme du droit matériel (citoyenneté européenne, politique sociale de l’Union, fonction publique européenne...), comme du droit international privé. Le droit de la famille de l’Union s’identifie alors comme un «droit spécial» complétant la diversité des droits nationaux de la famille. Sa signification théorique et politique dans l’Union est débattue par les auteurs, autant que son devenir. Loin de demeurer fragmentaire à côté des droits nationaux des États membres, il a probablement vocation à se densifier pour offrir aux citoyens et résidents européens un droit commun de la famille au sein de l’Union. Family law, with its civil law tradition, and strong roots in the national cultures of the Member States, does not normally fall within the scope of European law. However, it is no longer possible to argue that family law is outside European law entirely. There are many aspects of the family which are subject to European influence, to the point that the outlines of a «European family» are starting to emerge. This book is intended to highlight the European experience of family law and its substantive (i.e. European citizenship, EU social policy, EU civil service...) and private international law aspects. Union law therefore contains a form of «special» family law which is shared between the Member States and supplements their national family laws. Its theoretical and political importance in the Union, as well as its future, are discussed by the authors. Far from remaining fragmented alongside the national laws of Member States, it will likely develop to offer European citizens and residents a common family law within the EU.

The linguistic integration of migrants affects every aspect of settling in a new country (employment, health, etc.). The aim of this collection of texts is to propose a number of specific measures member states can take to help adult migrants become acquainted with the language of the host country. The main focus is on organising language courses that meet migrants’ real communication needs. It is not enough for authorities simply to consider the technical aspects of such courses, they should also design and conduct them in accordance with the fundamental values of the Council of Europe. A number of issues concerning the linguistic integration of adult migrants are presented here, beginning with the notion of linguistic integration itself. Family reunion, the nature of citizenship and the function of language tests, among others, are dealt with from the point of view of language and language use. Readers are invited to reflect on the type of language competences that need to be acquired as well as an appropriate use of the Common European Framework of Reference for Languages. The collection also sets out approaches and instruments designed to assist in implementing effective policies.
