Os artigos presentes neste livro são fruto das discussões do XV Fórum de Analise de Conjuntura, organizado pelo Grupo de Pesquisa Estudos da Globalização e ocorrido entre 16 e 18 de novembro de 2015 na Faculdade de Filosofia e Ciências (FFC) da Universidade Estadual Paulista (UNESP). Abordaram a conjuntura econômica e política dos principais países da América Latina, com especial atenção ao Brasil, que vive complexa crise econômica e política. Em termos mais gerais, os temas do desemprego, do meio ambiente, da desigualdade social, do acesso a serviços públicos universais, das estratégias de desenvolvimento e inserção na economia mundial, do grau de autonomia dos Estados nacionais de levar a cabo políticas econômicas voltadas para o atendimento das demandas sociais e o crescimento sustentado ante aos interesses financeiros dominantes, do esgarçamento das formas de vida, de fazer política e de organização econômica foram os pontos discutidos no Fórum de Conjuntura. O capital, embora abalado pela crise, busca responder os graves problemas de valorização que enfrenta, sobretudo devido a existência de uma massa enorme de capital fictício, por meio da intensificação da exploração do trabalho. Isto significa aprofundar a precarização das condições de trabalho, reduzir os salários e as aposentadorias, reduzir os gastos com programas sociais (educação, saúde, moradia, saneamento etc.), concentrar ainda mais a renda e cortar os direitos sociais e trabalhistas. Apesar da resistência das classes populares, que até o momento não têm logrado sucesso em sua luta, esta saída tem sido implementada em toda parte sob a égide do neoliberalismo. Seja na Europa, onde a Grécia é um caso exemplar, seja na América Latina.

This book defends the idea that there are significant structural and institutional differences between the countries in Latin America. Building off the results of a four-year research project, Bizberg argues against the idea that in Latin America there is one single type of capitalism—a hierarchical one—that is entangled in a vicious cycle. Rather, there are clusters of countries that have had similar historical trajectories, analogous structures, or comparable reactions to changes to the world economy, but have not all followed the same mode of development. Just as analysts have found a variety of capitalisms in developed countries, it is possible to identify the emergence of different types of capitalism in Latin America since the 1980s debt crisis. These varieties of capitalism are defined according to categories—including the articulation to the world economy, the role of the State, the structure of the political system and the action of civil society—which give rise to distinct wage relations, comprising the industrial relations system and the welfare regime.

O livro é o resultado da pesquisa de mestrado sobre os reflexos das biotecnologias para a intervenção na vida do outro – em especial aquelas realizadas no estágio embrionário – em estruturas clássicas do pensamento do Direito Civil. Reflete-se sobre os conceitos de embrião, nascituro e pessoa, e estudam-se, à luz de um viés filosófico, as intervenções genéticas na vida do outro. As fontes obrigacionais são analisadas, com foco no estudo da ilicitude objetiva, à luz do art. 187 do Código Civil. A obra examina o ordenamento jurídico brasileiro e as normas, editadas ou em tramitação, sobre reprodução assistida, em especial sobre a seleção embrionária. No livro, como o título sugere, parte-se de uma posição teórica discursiva do Direito e, com isso, busca-se chegar a uma melhor compreensão sobre os reflexos das novas técnicas que levam a intervenções na vida do outro e se o ordenamento jurídico brasileiro atualmente seria suficiente para dar as respostas corretas a esses novos desafios.
