Excerpt from Outline of the Jurisdiction and Procedure of the Federal Courts This book is intended as a manual or ready reference book for law students and others who may desire to learn or make use of the elements of the subject of Federal Jurisdiction and Procedure without having to search through the voluminous Works which treat this subject exhaustively. The main part of the book is based upon a course of lectures which the author delivered for a number of years in the School of Law of Washington and Lee University. It presents in a brief but fairly compre hensive manner the subject of federal jurisdiction in general, and describes fully the several courts of the fed eral judicial system, with the details of their organization, jurisdiction, etc. One chapter is devoted to the subject of Removal of Causes and another to a brief description of the procedure of the federal courts. Then follows an outline of a suit in equity under the new Federal Equity Rules. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Excerpt from Jurisdiction and Procedure of the Federal Courts The first edition of this book was published in 1915. It was intended to state and illustrate the fundamental principles governing the jurisdiction and procedure of the Federal Courts concisely and clearly, so that it would be of use both to those who had previously had little familiarity with Federal practice, and to those who, frequently engaged in the Courts of the United States, wanted readily at hand a precise and accurate statement of the basic rules, with references to the leading cases in which they had been laid down and applied. The present second edition is enlarged and brings the work down to date. The appendix contains the Judicial Code, with all amendments made to it up to the adjourn ment of Congress in September, 1922. The author is indebted to Mr. Robert France of Balti more for a verification of the references. Everything else in it has been personally prepared by him. Excerpt from Handbook of Jurisdiction and Procedure in United States Courts This treatise is designed to fulfill the usual functions of the Hornbooks on the subject of which it treats. It does not pur port to be an exhaustive or elaborate discussion, as such a plan would involve several volumes, instead of one. It is, however, intended to be a means of ready reference to the law on those questions of ordinary routine which the author's experience as a specialist in federal practice has taught him most frequently arise. It is believed that the need exists for a work of this character, notwithstanding the several excellent text-books covering the general subject which go into much greater de tail. The work is designed, also, for use in law schools, where the need of such a treatise seems to be specially apparent. The author has taken great pains to adapt it to this need. In order to render it more available for this purpose, he has inserted in the appendix a table of illustrative cases, which he hopes will be found useful by those teachers who prefer the case system. It has seemed to the author much better and simpler in the discussion of the subject to commence with the inferior courts and follow up through the courts of last resort, though that is not the usual scheme adopted by other text-books on the sub ject. While this plan involves some duplication and cross referencing in case of subjects of which the different federal courts have concurrent jurisdiction, its advantage in enabling the student to trace a case from its inception to its final con elusion is so great as to have convinced the author that it is the best method of treating the subject. Excerpt from Zoline on Appellate Jurisdiction and Procedure: In All Federal Courts and in All the Reviewing Courts of the State of New York; With Federal Forms Second - The law relating to federal appellate jurisdiction and procedure has undergone many changes, namely, by the passage of the Federal Judicial Code in 1910; by the promulgation of the new Federal Equity rules in 1912; by various amendments to the Judicial Code in 1913 and 1915, and again as recently as September 1916. In addition are the many rules of court and the decisions construing both the statutes and the rules. N 0 little uncertainty and confusion have resulted. The foregoing statement explains the need of a book brought down to date, treating the subject of federal appellate jurisdiction and procedure as a separate and distinct branch of the law. The Federal Courts written by Richard A. Posner and has been published by Harvard University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2009-07-01 with Law categories.

The federal courts are the world’s most powerful judiciary and a vital element of the American political system. In recent decades, these courts have experienced unprecedented growth in caseload and personnel. Many judges and lawyers believe that a “crisis in quantity” is imperiling the ability of the federal judiciary to perform its historic function of administering justice fairly and expeditiously. In a substantially revised edition of his widely acclaimed 1985 book The Federal Courts: Crisis and Reform, Chief Judge Richard A. Posner of the U.S. Court of Appeals for the Seventh Circuit provides a comprehensive evaluation of the federal judiciary and a detailed program of judicial reform. Drawing on economic and political theory as well as on legal analysis and his own extensive judicial experience, Posner sketches the history of the federal courts, describes the contemporary institution, appraises the concerns that have been expressed with the courts’ performance, and presents a variety of proposals for both short-term and fundamental reform. In contrast to some of the direr prophecies of observers of the federal courts, Posner emphasizes the success of these courts in adapting to steep caseload growth with minimum sacrifice in quality. Although the book ranges over a variety of traditional topics in federal jurisdiction, the focus is steady on federal judicial administration conceived of as an interdisciplinary approach emphasizing system rather than doctrine, statistics rather than impressions, and caseload rather than cases. Like the earlier edition, this book promises to be a landmark in the empirical study of judicial administration.
