Responding to a pressing need for a focussed study of India's public institutions, Singh and Roy put together the first comprehensive monograph-length study of the Election Commission (EC) of India. They probe the consistent credibility that the EC enjoys as a non-partisan constitutional body entrusted with the responsibility of conducting elections in India. The EC is generally seen as a regulatory body which enforces rules to conduct elections effectively and efficiently. The authors argue that the EC must be seen as performing a range of functions, not all of which are regulatory. The EC is actively engaged in framing and implementing rules to ascertain procedural certainty in order to ensure the democratic principle of uncertainty of electoral outcome. Innovations in conducting elections which are often seen through the lens of electoral 'management' and 'electoral integrity' have become part of the deliberative content of elections. The work also examines the relationship between the legal-institutional frameworks of electoral governance within the larger institutional matrix of democracy, and the political field in which they are located. The latter, the authors argue, both limit and enable the effectiveness of the EC in the shared space of democracy in India.

As the constitutional body that conducts elections, the Election Commission of India (ECI) has emerged as a trusted institution within the shared space of democracy in India. This process has, however, been a fraught one because of contestation over the ECI's constitutional responsibility and the power of Parliament to make laws to govern electoral matters. This comprehensive monograph discusses the history of the ECI through a study of the measures it has adopted to ensure certainty of procedures in order to maintain the democratic uncertainty of electoral outcome. In this context, innovations such as the Model Code of Conduct have enhanced the rule-making powers of the ECI. Going beyond the ECI's design and performance framework, Singh and Roy argue that changes in the nature of electoral contests and domination of political regimes have made the task of preserving electoral integrity and assuring its deliberative content a challenging one.

"This book offers an insight into the contribution of the Election Commission of India (EC) to the Indian democratic process through its regulatory role in conducting elections between 1990 and 2019. It elaborates upon the EC's interactions with pivotal state institutions - the parliament, the Supreme Court and political parties - to streamline democratic procedures during the aforementioned period. It demonstrates a comparison between important electoral procedures in India and those in other liberal democracies (Canada, the United States, the United Kingdom and South Africa, among others) to highlight the role of electoral institutions in democratisation. It also studies the sociopolitical situatedness of the EC as a body that moulds the political culture in India"--

Constitutional Resilience In South Asia written by Swati Jhaveri and has been published by Bloomsbury Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 2023-06-01 with Law categories.

South Asia has had a tumultuous and varied experience with constitutional democracy that predates the recent rise in populism (and its study) in established democracies. And yet, this region has remained largely ignored by constitutional studies and democracy scholars. This book addresses this gap and presents a contribution to the South Asia-centric literature on the topic of the stability and resilience of constitutional democracies. Chapters deal not only with relatively well known South Asian countries such as India, Bangladesh, Pakistan, and Sri Lanka, but also with countries often ignored by scholars, such as Bhutan, Nepal, Maldives, and Afghanistan. The contributions consider the design and functioning of an array of institutions and actors, including political parties, legislatures, the political executive, the bureaucracy, courts, fourth branch / guarantor institutions (such as electoral commissions), the people, and the military to examine their roles in strengthening or undermining constitutional democracy across South Asia. Each chapter offers a contextual and jurisdictionally-tethered account of the causes behind the erosion of constitutional democracy, and some examine the resilience of constitutional institutions against democratic erosion.
