In this first comprehensive examination of the movement, Patrick Frank explores the work of four artists at its heart--Jorge de la Vega, Luis Felipe Noé, Rómulo Macció, and Ernesto Deira--to demonstrate the importance of their work in the transnational development of modern art. The artists were responding directly to a difficult and chaotic period characterized by civil strife, frequent changes of government, and economic shocks. They broke new ground in Latin American art, not only in their technique, but also in the way they engaged the social, political, and cultural climate in an Argentina still recovering from the Perón years. Building on postwar expressionism by working with unprecedented urgency and abandon, they combined spontaneous techniques of abstraction with collage elements and figural subjects. Their works exercised a creative freedom that broke taboos about the role of the artist in society. Two months after the attacks of 9/11, the Bush administration, in the midst of what it perceived to be a state of emergency, authorized the indefinite detention of noncitizens suspected of terrorist activities and their subsequent trials by a military commission. Here, distinguished Italian philosopher Giorgio Agamben uses such circumstances to argue that this unusual extension of power, or "state of exception," has historically been an underexamined and powerful strategy that has the potential to transform democracies into totalitarian states. The sequel to Agamben's Homo Sacer: Sovereign Power and Bare Life, State of Exception is the first book to theorize the state of exception in historical and philosophical context. In Agamben's view, the majority of legal scholars and policymakers in Europe as well as the United States have wrongly rejected the necessity of such a theory, claiming instead that the state of exception is a pragmatic question. Agamben argues here that the state of exception, which was meant to be a provisional measure, became in the course of the twentieth century a normal paradigm of government. This study demonstrates the extensive protection that international law provides to human rights even in the most serious of emergencies when they are particularly vulnerable. Based on a meticulous analysis of preparatory works and practice under the International Covenant on Civil and Political Rights, as well as the American and European Conventions on Human Rights, and with a special chapter on the International Labour Organisation's approach to international labour standards and emergencies, this book shows that respect for the rule of law and the concept of a democratic society are controlling parameters in any valid limitation on the enjoyment of human rights. It further shows that respect for human rights and the operation of institutions such as the Legislature and Judiciary are crucial to enabling societies to address and eventually remedy the root causes of emergency situations. The state of emergency, according to thinkers such as Carl Schmidt, Walter Benjamin, and Giorgio Agamben, is at the heart of any theory of politics. But today the problem is not the crises that we do confront, which are often used by governments to legitimize themselves, but the ones that political realism stops us from recognizing as emergencies, from widespread surveillance to climate change to the systemic shocks of neoliberalism. We need a way of disrupting the existing order that can energize radical democratic action rather than reinforcing the status quo. In this provocative book, Santiago Zabala declares that in an age where the greatest emergency is the absence of emergency, only contemporary art’s capacity to alter reality can save us. Why Only Art Can Save Us advances a new aesthetics centered on the nature of the emergency that characterizes the twenty-first century. Zabala draws on Martin Heidegger’s distinction between works of art that rescue us from emergency and those that are rescuers into emergency. The former are a means of cultural politics, conservers of the status quo that conceal emergencies; the latter are disruptive events that thrust us into emergencies. Building on Arthur Danto, Jacques Rancière, and Gianni Vattimo, who made aesthetics more responsive to contemporary art, Zabala argues that works of art are not simply a means of elevating consumerism or contemplating beauty but are points of departure to change the world. Radical artists create works that disclose and demand active intervention in ongoing crises. Emergency Politics in the Third Wave of Democracy aims to make an important contribution to the study of emergency politics by offering an up-to-date study of how it works in practice. Specifically, it studies the uses given to the “regime of exception” mechanism in Bolivia, Ecuador, and Peru in the first decade of the 21st century and analyzes potential incompatibilities with the two pillars of democratic governability: efficiency and legitimacy. This book offers a thorough review of existing literature on emergency politics, offering conceptual clarification, identifying three types or paradigms of emergency politics (repressive, administrative, and disaster) and pointing to regimes of exception as a useful route to their study. It also provides an overview of emergency politics in Latin America throughout history, pointing to the predominance of regimes of exception and the repressive paradigm. The book describes the continuity of the repressive paradigm in Peruvian emergency politics to deal with both social protest and the apparent threat of organized crime and terrorism, as well as how Bolivia has shifted from a repressive to a disaster paradigm in the face of pressure to deal with climate change. It also analyzes the predominance of an administrative paradigm in Ecuadorian emergency politics in the context of weak institutions and difficulties in implementing policy as well as a populist style of leadership. Ultimately, the book offers some “best practices” in relation to the design and use of regimes of exception in democratic contexts. Other studies on emergency politics tend to focus on legal or formal issues in the context of the United States War on Terror. This study is decidedly political and empirical in focus, offering analysis and interpretation as a result of intensive fieldwork carried out by the author in Bolivia, Ecuador, and Peru.
