L’opera raccoglie, in seguito al Primo Congresso Internazionale di Diritto delle Famiglie e delle Successioni “Nuovi paradigmi della filiazione”, gli scritti di autori italiani, spagnoli e latino-americani i quali, attraverso un confronto tra gli ordinamenti, riflettono a vario titolo sui nuovi paradigmi della filiazione e sulle loro implicazioni nel diritto delle famiglie e nel diritto successorio, con particolare attenzione alle rilevanti questioni di diritto internazionale privato. Attraverso un approccio sistematico e assiologico l’opera mira ad analizzare il mutato contesto familiare – dalla famiglia alle famiglie – e a valutarne le molteplici conseguenze che impongono una rilettura degli istituti tradizionali nel rispetto dei princìpi degli ordinamenti presi in considerazione. La multiparentalità, le tecniche di riproduzione assistita, l’evoluzione dei rapporti di filiazione e tutti i nuovi temi posti dall’evoluzione sociale in campo familiare, che spesso sfuggono ai confini nazionali, richiedono infatti all’interprete un bilanciamento nel caso concreto con particolare – ma non esclusivo – riferimento al miglior interesse del minore.
