Excerpt from Patenting and Promoting Inventions Inventor, Promoter, Capitalist. Here we have the trinity, each factor having the same ultimate aim, but usually with divergent views as to how this aim is to be realized. The inventor has always been confronted by the lack of capital, and must seek the services of the promoter, while the promoter is depend ent upon the inventor as the original source of his projects. The capitalist, in turn, must look to both these factors to furnish profitable avenues of investment, but he must further rely upon the services of the expert engineer. Excerpt from Patents, Copyrights, and Trade Marks The Patent Laws of the United States are founded on Art. 1, 8 of the Constitution, which says: The Congress shall have power to promote the progress of science and useful arts by securing for limited times to authors and inventors the exclusive right to their respec tive writings and discoveries. In accordance with this delegation of power, Congress has enacted laws giving to authors and inventors the exclusive control of their writings and discoveries. This exclusive control is not given to them because an inventor has any moral right to prevent others from enjoying the fruits of his new ideas, but because it was recognized that, by giving him the exclusive control of his invention for a short period, the arts would be encouraged, the public would obtain the right to enjoy the invention after that period, and the prosperity of the country would be increased thereby. That these results have been accomplished is evident. Morse would probably not have struggled to produce the telegraph, nor Eli Whitney to produce the cotton gin, Goodyear would not have gone through years of abject poverty in order to accomplish the successful vulcanization of rubber, Edison would probably not have given to the world the incandescent electric light, nor Bell the tele phone, without the hope of a reward, - and these are only a few of the many inventions which have been the result of years of experiment and which have made this country the manufacturing center of the world. This reward is not, however, given to the inventor for his mere production of the new thing. The Govern ment enters into a contract with him, and gives him a patent in consideration of his disclosing the invention inhis patent in such full, clear, concise, and exact terms as to enable any person skilled in the art or science to which it appertains or with which it is most nearly connected, to make, construct, compound and use the same, to the end that the public may be able, at the expiration of the limited time, to reproduce and enjoy the invention. If the patent does not so disclose it, the patent is void. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Excerpt from Patents as a Factor in Manufacturing In the preparation of the work the author has been guided by the results of wide practice, both in mechanical engineering and in patent law. The subject matter has been carefully prepared in View of his experience in patenting, litigating, and establishing many well-known inventions, and covers the points which leading cases have shown to be important and which conferences with clients have shown to be most necessary to establish in the lay mind. To the inventor and the patentee the most significant portion will be the clear outline of the precautions which should be taken in the preliminary steps, the rules and principles by which safe advance may be made up to a certain point, and the demonstration of the great advantage as well as the necessity of securing competent legal assistance in carrying the matter through 'the Patent Office. To the manufacturer, equal or greater significance will appear in the demonstra tion of the great commercial advantages which may be secured by proper use of patents in the shop, in dealing with employees, in the sales office, and indeed in the creation and pre - emption of valuable markets. Excerpt from Patent Laws and Practice of Obtaining Letters Patent for Invention: In the United States and Foreign Countries, Including Copy-Right and Trademark Laws The compiler of the following pages lays no claim to the authorship of an original work upon the law of patents. Entertaining the opinion that the speculations even of the most learned are of but little importance to those who are seeking to know simply what the law is, and actuated by a desire to render the work strictly authoritative and practical, he has adopted, almost exclusively, the conclusions of those whose opinions have been dignified with the mantle of official authority. The work is the result of an endeavor to compile from various sources, some of which are not easily accessible, reliable and practical information, which the author has found to be indispensable in the course of his own professional practice, and which he believes will be useful to others. Although intended to convey practical information to inventors, patentees, manufacturers, and other who have occasion to inform themselves particularly concerning patent matters, it is believed that the work will be found useful to members of the legal profession generally, since it sets forth the state of the law resulting from decisions more recent than those of any other work published up to the present time, and contains the exact text of the late act of Congress, by which the entire legislation in respect to patents and copy.
