Konsep perlindungan hak cipta telah memberikan hak eksklusif atas suatu ciptaan yang dihasilkan dalam lapangan seni, sastra dan ilmu pengetahuan bagi penciptanya secara otomatis berdasarkan sistem deklaratif. Konsekuensi dari konsep perlindungan hak cipta ini, maka pemegang hak cipta berhak untuk menggunakan sendiri ciptaannya, mengizinkan pihak lain menggunakan ciptaannya, mengalihkan kepada pihak lain ciptaannya dan melarang kepada pihak lain untuk menggunakan, mengizinkan atau mengalihkan ciptaannya. Berdasarkan konsep perlindungan hak cipta ini, maka “terkesan” bahwa hak cipta tidak membuka pihak lain untuk memperoleh hak akses atas ciptaan yang dilindungi hak cipta. Padahal, apabila diperhatikan konsep perlindungan hak cipta sebenarnya memberikan hak akses atas ciptaan yang dilindungi hak cipta tanpa harus melanggar hak eksklusif yang dimiliki oleh pemegang hak cipta melalui mekanisme pembatasan dan pengecualian hak cipta. Adapun mekanisme pembatasan dan pengecualian hak cipta, di antaranya pengutipan ciptaan untuk kepentingan pendidikan, penggandaan program computer untuk kepentingan arsip, penggandaan ciptaan untuk kepentingan pribadi atas ciptaan yang telah dilakukan pengumuman dan banyak lagi hal lainnya. Persoalan pembatasan dan pengecualian hak cipta ini menjadi semakin menarik apabila dihubungkan dengan isu hak cipta di era digital. Bagaimanapun, dalam kenyataannya medium digital seperti internet telah membuka secara lebar akses informasi kepada semua pihak. Dengan dibukanya akses informasi melalui internet ini, maka membuka peluang bagi siapapun untuk dapat mengakses informasi tersebut. Nah, agar proses mengakses informasi yang ada di internet, di mana informasi tersebut mungkin saja dilindungi hak cipta, maka perlu dipahami secara menyeluruh dan utuh konsep hak cipta yang sifatnya memberikan hak eksklusif di satu sisi, namun di sisi lain memberikan pembatasan dan pengecualian hak cipta itu sendiri. Dengan memiliki pemahaman yang menyeluruh dan utuh ini, maka pelanggaran hak cipta di era digital dapat diminimalisir sedemikian rupa. Pengaturan karya cipta seni tari tegalan menurut Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta (UUHC) terdapat pada pasal 40 Undang-Undang Hak Cipta (UUHC). Point E dalam pasal 40 Undang-Undang No. 28 Tahun 2014 mencantumkan secara eksplisit bahwasanya tari termasuk pada objek ciptaan yang dilindungi Hak Cipta. Perlindungan Hak Cipta karena berhasil memenuhi prinsip yang dipegang oleh Hak Cipta seperti terdapat kreativitas atau kemampuan tertentu yang dituangkan pada ekspresi ide atau gagasan, telah memenuhi prinsip Fixation atau Tangible karena seni tari telah diwujudkan secara nyata, memenuhi prinsip keaslian atau originalitas yakni seni tari tegalan yang diciptakan bukan semata-mata meniru karya orang lain. Urgensi pencatatan Hak Cipta seni tari tegalan kepada Direktorat Jenderal Kekayaan Intelektual (DJKI) dikarenakan tahun 2022 dicanangkan sebagai tahun Hak Cipta, Pencatatan terhadap Seni Tari Tegalan dapat menjadi bukti awal kepemilikan apabila terjadi klaim Hak Cipta. Cyberpragmatics is an analysis of Internet-mediated communication from the perspective of cognitive pragmatics.
