Tienduizenden personen werden reeds overgeleverd tussen EU-lidstaten op basis van instrumenten zoals het Europees arrestatiebevel. Telkens wordt een persoon geconfronteerd met detentiecondities in een andere lidstaat en een andere detentiecultuur. Dit hoeft, volgens de EU-lidstaten, geen probleem te zijn: aangenomen wordt dat de detentiecondities in alle lidstaten gelijkwaardig zijn. In toenemende mate blijkt echter dat de overlevering kan leiden tot schendingen van fundamentele rechten en de opsluiting in veilige, humane noch resocialiseringsgerichte omstandigheden. In dit onderzoek wordt dieper ingegaan op detentiecondities in EU-lidstaten. Één aspect van de detentie wordt er specifiek uitgelicht – het tuchtrecht – gezien de impact die het tuchtrecht kan hebben op de leefomstandigheden in de gevangenis (denk bv. aan de opsluiting in een strafcel, het verlengen van de detentieduur of het beperken van het familiebezoek). Er wordt in de diepte bestudeerd of het tuchtregime verloopt conform de internationale detentiestandaarden. In het boek wordt elke internationale detentiestandaard m.b.t. het tuchtrecht tegen het licht gehouden en wordt onderzocht of in de wetgeving en in de praktijk deze standaarden worden nageleefd. Nadien wordt bekeken welke juridische gevolgen de niet-naleving van deze internationale standaarden heeft op de samenwerking tussen lidstaten.

Het voorbije anderhalve decennium werd duidelijk gekenmerkt door een versterking van de interne rechtspositie van de gedetineerde binnen het penitentiair tuchtrecht. Zo werden in 2011, na meerdere wetswijzigingen, de bepalingen met betrekking tot het penitentiair tuchtrecht uit de basiswet0grotendeels van kracht. Dit leidde onder andere tot de invoering van een limitatieve lijst van tuchtinbreuken en tuchtsancties en het uitwerken van een formele tuchtprocedure waarbij de gedetineerde een steeds actievere rol speelt. Deze ontwikkelingen hebben echter ook geleid tot een complexer tuchtregime waarbij een toenemend aantal actoren betrokken zijn en waarbij de initiële voorschriften verder werden ontwikkeld via wetgeving, beleidsdocumenten en jurisprudentie.0Dit boek wenst daarom duiding te bieden bij het huidig penitentiair tuchtrecht. Binnen welk rechtskader kan elk van de actoren manoeuvreren en van welke rechten en plichten genieten de gedetineerden? Er wordt veelvuldig verwezen naar de verschillende bronnen van het penitentiair tuchtrecht (de basiswet en de relevante koninklijke besluiten, het algemeen reglement van de strafinrichtingen, de algemene rechtsbeginselen, de collectieve brieven en andere beleidsdocumenten) en de recente nationale en internationale jurisprudentie omtrent het onderwerp. ‘Strafrecht en strafprocesrecht in hoofdlijnen’ is een standaardwerk in de Belgische rechtsliteratuur. Het boek werd voor de twaalfde editie volledig bijgewerkt tot 1 juli 2022.
