Penulisan buku ini mengangkat isu sentral upaya-upaya hukum (legal remedies) penyelesaian pelanggaran HAM (hak-hak asasi manusia atau human rights) di Indonesia dalam rangka memenuhi hak korban pelanggaran HAM atas reparasi (reparation). Isu tersebut, karena merupakan isu hukum (legal issue atau question of law), akan dibahas atau didiskusikan atas dasar hukum yang berlaku, yang telah menyediakan, dan mengatur, upaya-upaya hukum penyelesaian pelanggaran HAM di Indonesia dalam rangka memenuhi hak korban pelanggaran HAM atas reparasi. Pembahasan atas isu hukum tersebut dibayangi oleh fakta kurang menggembirakan di mana sudah beberapa rezim berganti, sejak Reformasi 1998, tetapi belum satupun yang mampu membuat satu keputusan politik yang melegakan bagi korban pelanggaran HAM terkait dengan kepastian untuk pemberian reparasi sebagai bentuk pertanggungjawaban negara. Buku ini hanya akan berbicara tentang hukum, yaitu hukum yang mengatur dan menyediakan upaya-upaya hukum yang dapat diakses oleh korban pelanggaran HAM untuk memperoleh haknya atas reparasi. Ratione loci, cakupan dari kerangka hukum yang akan didiskusikan adalah Hukum Nasional Indonesia (upaya hukum nasional) dan Hukum Internasional (upaya hukum internasional). Dalam pembahasan, buku ini tidak sekadar mendeskripsikan 'hukum yang ada' secara bebas nilai; tetapi juga, lebih banyak, mengkritisi dan kemudian mengusulkan 'hukum yang seharusnya'. Buku ini dilengkapi pula dengan bab EPILOG yang hendak menanggapi secara khusus isu pelanggaran HAM masa lalu yang dikatagorikan sebagai historical injustice. Konsep historical injustice adalah katagori pelanggaran HAM masa lalu yang sifatnya lebih spesifik. Oleh karena itu, isu pelanggaran HAM yang sudah memasuki fase sebagai historical injustice perlu ditanggapi secara lebih serius, termasuk alternatif atau pilihan untuk upaya hukumnya. In the early morning hours of October 1, 1965, a group calling itself the September 30th Movement kidnapped and executed six generals of the Indonesian army, including its highest commander. The group claimed that it was attempting to preempt a coup, but it was quickly defeated as the senior surviving general, Haji Mohammad Suharto, drove the movement’s partisans out of Jakarta.
