La prima parte del volume offre al lettore argomentazioni e riflessioni sui problemi etici e giuridici suscitati dallo sviluppo sempre più accelerato della scienza e delle tecnologie. I grandi progetti, che riguardano i geni e il genoma, la vita artificiale, l’eugenia e la clonazione, la procreatica, sono la realizzazione dell’odierna “utopia biotecnologica” che vede referenti principali gli scienziati, le industrie, lo Stato e i media. In essa si trovano i nuovi poteri, le nuove fonti di profitto del terzo millennio. Ma come qualsiasi potere ripropone all’uomo di oggi il problema antico della salvaguardia della propria identità, dignità, libertà e della uguaglianza formale di sé con gli altri uomini. La questione, allora, dell’opportunità e dei limiti di un intervento del diritto occupa un posto primario nel dibattito contenuto nel volume, che tiene altresì conto delle scelte e dell’esperienze legislative e giurisprudenziali non solo del nostro Paese, ma anche di quelle europee e nordamericane. La seconda parte svolge le problematiche ingenerate dal rapporto di cura tra medico-paziente con particolare attenzione alle c.d. scelte di fine vita, alle cure palliative, all’accanimento clinico, alle dichiarazioni anticipate di trattamento. Accanto al dibattito culturale sulla vita come bene disponibile, viene ricostruito il percorso giurisprudenziale sviluppatosi in questi decenni in merito alla rilevanza del consenso informato del paziente nell’ambito del trattamento sanitario, fino a giungere alla L. n. 219/2017 sul Consenso informato e sulle disposizioni anticipate di trattamento. Lorenzo d’Avack è Professore emerito di Filosofia del diritto e Professore di Bioetica e Biodiritto nel Dipartimento di Giurisprudenza dell’Università di Roma Tre. È Professore a contratto di Metodologia della Scienza Giuridica presso l’Università LUISS-Guido Carli. È stato membro del Comitato Nazionale per la Bioetica dal 2002, ricoprendo i ruoli di Vice-Presidente e Presidente-Vicario negli anni 2007-2017. È avvocato cassazionista. I suoi lavori scientifici vertono su problematiche di storia costituzionale inglese, di teoria generale del diritto, di diritto di famiglia, di bioetica e biodiritto. The panorama of bioethical problems is different today. Patients travel to Thailand for fast surgery; commercial surrogate mothers in India deliver babies to parents in rich countries; organs, body parts and tissues are trafficked from East to Western Europe; physicians and nurses migrating from Africa to the U.S; thousands of children or patients with malaria, tuberculosis and AIDS are dying each day because they cannot afford effective drugs that are too expensive. Mainstream bioethics as it has developed during the last 50 years in Western countries is evolving into a broader approach that is relevant for people across the world and is focused on new global problems. This book provides an introduction into the new field of global bioethics. It was the classical task of legal rhetoric to make law both seen and understood. These conjoint goals came to be separated and opposed in modernity and a degree of blindness ensued. Law always relied in significant measure upon the use of visual representations, upon pictures, architecture, costume and statuary to convey authority and sovereign norm. Military, religious, administrative and legal insignia found juridical codification and expression in collections of signs of office, in heraldic codes, in genealogical devices, and then finally in the juridical invention in the mid-sixteenth century of the legal emblem book. Genealogies of Legal Vision traces the complex lineage of the legal emblem and argues that the mens emblematica of the humanist lawyers was the inauguration of a visiocratic regime that continues into the multiple new technologies and novel media of contemporary governance.
