La historia de los Derechos Fundamentales participa de las veleidades de sus protagonistas: por una parte, consagran la idea de igualdad para todos, en abstracto, que preside la aparición del Estado de Derecho y de los primeros textos constitucionales y legales, y por otra, defienden el trato discriminatorio y la inferioridad de las mujeres. En el ámbito de lo público su exclusión alcana el grado máximo en todas las instituciones representativas o emanantes del poder político, aún cuando las mujeres podían votar y ser elegidas. A finales del siglo XX las mujeres comienzan a reclamar su participación den las instituciones democráticas donde su presencia sigue siendo irrelevante. Los organismos internacionales y europeos se unen a estas demandas proponiendo medidas que les garanticen un lugar y su intervención en los procesos de decisión política. Así surge el término “Democracia Paritaria” que adquiere significado en la Cumbre de Mujeres en el Poder, celebrada en Atenas, para expresar el déficit que para la democracia, como sistema político, supone que el 50% de la población no participe directamente en la toma de decisiones. En el libro se exponen los argumentos que ha generado esta propuesta, el intento de darlos a conocer y de demostrar, sobre todo, la constitucionalidad y la justicia de la misma.
