Eksistensi pesantren di Nusantara bukan hanya sebatas “ada”, namun lebih dari itu turut menyumbang dan membangun peradaban di Indonesia, terutama dalam konteks pendidikan Islam. Lembaga ini tidak hanya tumbuh dari segi kuantitas, tetapi juga secara subtantif berkembang dalam ruang kualitas hingga saat ini cukup mudah ditemukan diberbagai daerah, mulai dari pedesaan hingga perkotaan. Dalam konteks ini, pesantren menjadi muldimensional yang mampu menjangkau nilai-nilai tradisionil sekaligus mampu berlayar dalam arus dan gelombang modernisasi pendidikan. Pesantren tidak mengenal dikotomic, lembaga ini tidaklah diperuntukkan untuk kaum abangan atau orang-orang berlatarbelakang ekonominya stabil tetapi juga ia dimasuki oleh masyarakat dari lapisan terendah sekalipun. Perkembangan pesantren sungguh menjadi sebuah keniscaya-an, paling tidak bila ditinjau dari sudut pandang demografis Indonesia yang mayoritas beragama Islam. Ia tumbuh dari masyarakat untuk negeri, pesantren tentu saja mampun survive tanpa dukungan pemerintah sekalipun, karena mamang historical pesantren sejak awal tidak pernah dikooptasi oleh penguasa. Keadaan seperti ini pada gilirannya tentu saja memunculkan dinamika yang kompleks, dan juga tentu tidak berdampak baik untuk jangka panjang, karena itu dibutuhkan langkah konkret untuk mengakomodasi pesantren untuk dapat “diakui” secara formil dalam Sistem Pendidikan Nasional. Terbitnya Undang-undang No. 18 Tahun 2019 tentang Pesantren menunjukkan babak baru dalam sejarah perkembangan pesantren. Melalui UU tersebut, pesantren didesain untuk menjadi lembaga yang otoritatif dan adaptif dengan tanpa menghilangkan ciri khasnya. Untuk merealisasikan cita-cita tersebut, pesantren dihadapkan dengan berbagai standar yang disusun oleh Pemerintah, hal ini dilakukan untuk mengukur eksisntensi pesantren berdasarkanciri khasnya yang “terstandar” selama ini digaungkan di lingkungan pesantren. Apakah semua pesantren mampu mengukuti standar tersebut?; buku ini mencoba mengidentifikasi pesantren berdasarkan standar yang disebutkan dalam UU pesantren, kemudian untuk merekomendasi arah tranformasi sistem pesantren tersebut untuk ke depannya. Kajian ini secara spesifik dilakuan di Wilayah Kabupaten Mandailing Natal yang akrab dikenal dengan kota “santri”.

What should be the place of Shari‘a—Islamic religious law—in predominantly Muslim societies of the world? In this ambitious and topical book, a Muslim scholar and human rights activist envisions a positive and sustainable role for Shari‘a, based on a profound rethinking of the relationship between religion and the secular state in all societies. An-Na‘im argues that the coercive enforcement of Shari‘a by the state betrays the Qur’an’s insistence on voluntary acceptance of Islam. Just as the state should be secure from the misuse of religious authority, Shari‘a should be freed from the control of the state. State policies or legislation must be based on civic reasons accessible to citizens of all religions. Showing that throughout the history of Islam, Islam and the state have normally been separate, An-Na‘im maintains that ideas of human rights and citizenship are more consistent with Islamic principles than with claims of a supposedly Islamic state to enforce Shari‘a. In fact, he suggests, the very idea of an “Islamic state” is based on European ideas of state and law, and not Shari‘a or the Islamic tradition.
