¿Qué puede aprender el arbitraje comercial internacional del arbitraje de inversión? Intentando resolver esta pregunta, Gary Born propuso los Tratados Bilaterales de Arbitraje (TBA o BAT por sus siglas en inglés). Los TBA son tratados por medio de los cuales dos Estados pactan que: una serie de controversias de carácter comercial, que surjan entre sus nacionales, serán resueltas vía arbitraje. Al día de hoy, no se ha celebrado ningún TBA, lo más cercano a su implementación ha sido un borrador de modelo creado por Gary Born. ¿Por qué estudiar una clase de tratados que aún no existe? El enfoque principal de la propuesta son los países en vía de desarrollo y las PYMES, como en el caso de Colombia. La propuesta de esta tesis es realizar una primera aproximación sobre la conveniencia de este tipo de tratados en nuestro país. Para ello, se examinaron algunos conceptos estructurales del ordenamiento jurídico. Posteriormente, se analizó la incidencia concreta de los TBA, examinando sus ventajas y desventajas, para concluir que sí podría ser una propuesta interesante para Colombia, sin dejar de lado algunos puntos sobre los que se deberá prestar especial atención.
