The State and the police are traditionally seen as closely connected phenomena. Today, however, rapid EU legal developments mean that European police forces are no longer tied to a specific national legal context or a specific territory in the way they used to be. Norway is not a member of the EU. Or is it? This book shows that although it lacks formal membership status, Norway has become part of almost all of the major EU police cooperation measures and agreements. Not only does this mean that foreign police forces may operate on Norwegian territory and vice versa, but in addition, a wide range of EU regulations and cooperation instruments are incorporated directly into Norwegian law. With the increased focus on international and transnational police cooperation in mind, what does it mean to be a sovereign state in Europe today? This book combines strong legal and theoretical analyses of a specific national system to show how this country is tied to and dependent on a wider international and supranational system of legal rules, technologies and concepts. Since the early 1990s, cross-border police and judicial cooperation has become a very important domain of the European Union. The Lisbon Treaty – if accepted by all the Member States – will certainly be a major stimulus to its further development in the field of internal security as well as in the field of external policy. In any event, the recent proposal for a new third comprehensive policy programme with regard to the Area of Freedom, Security and Justice – the so-called Stockholm Programme – foreshadows some of the changes the Brussels institutions and the Member States would like to embrace in the coming years. In the European Union, with the coming into force of the Treaty in 1993, police cooperation gained a solid position on the European political agenda. Since then, the EU Council has adopted a significant number of policy instruments aimed at enhancing police cooperation between the EU Member States. But what has been the effect of these instruments on the practices of police cooperation, and how can differences in effect be explained? These two questions guide this doctoral study that investigates 70 instruments adopted by the EU Council between 1995 and 2004. Data for the field research was collected from numerous Council documents and interviews with police practitioners, and was analyzed using both quantitative and qualitative techniques. The book presents the findings of the study, starting with an examination of key concepts related to police cooperation in Europe. It goes on to discuss academic literature on police cooperation, to give an overview of relevant developments in police cooperation practice in Europe and a detailed description of EU Council policy-making on police cooperation. The findings of the field research indicate that, in the shaping of EU Council policy instruments aimed at enhancing police cooperation, it is important to elevate substance (professional rationality) over form (legal nature).
