Upon achieving independence from Great Britain in 1948, the stunningly beautiful island of Ceylon, re-named Sri Lanka in 1972, was expected to become a sort of 'South Asian Singapore'. However, stable political order and bright economic prospects proved insufficient to maintain peace. A host of unsolved ethnic conflicts and social inequalities conspired to erupt into an armed conflict in 1971. By 1987, the crisis heated up to the point where the government in New Delhi began exercising fierce pressure upon the Sri Lankan government and the Sri Lankan Tamil insurgents to arrive at a peace deal. In order to help maintain peace, the Indian Peace Keeping Force was deployed on the island. However, with a few weeks, the troops of the Indian Army found themselves involved in a bloody and protracted confrontation with the most powerful of Tamil insurgent movements - the Liberation Tamil Tigers of Elam (LTTE). The peacekeeping operation was thus quickly converted into a military intervention and a bloody quagmire. To make matters even more complex, southern Sir Lanka meanwhile became engulfed in an unprecedented wave of public violence, triggered by the second insurrection of Sinhalese ultra-leftist movement, the JVP. Calling upon extensive studies of the Sri Lankan War, with the help of first hand sources, official documentation and publications from all of the involved parties, this volume provides an in-depth and particularly detailed account of military operations between 1987 and 1990. It is illustrated by over 120 photographs, maps and 12 color profiles.

This book examines the engagement between the United Nations’ human rights machinery and the respective governments since Sri Lanka (then Ceylon) joined the United Nations. Sri Lanka has a long and rich history of engagement with international human rights instruments. However, despite its active membership in the UN, the country’s post-colonial trials and tribulations are emblematic of the limited influence the international organisation has exerted on this country in the Global South. Assessing the impact of this international engagement on the country’s human rights infrastructure and situation, the book outlines Sri Lanka’s colonial and post-colonial development. It then considers the development of a domestic human rights infrastructure in the country. It also examines and analyzes Sri Lanka’s engagement with the UN’s treaty-based and charter-based human rights bodies, before offering conclusions concerning the impact of said engagement. The book offers an innovative approach to gauging the impact of international human rights engagement, while also taking into account the colonial and post-colonial imperatives that have partly dictated governmental behaviour. By doing so, the book seeks to combine and analyse international human rights law, post-colonial critique, studies on biopower, and critical approaches to international law. Foreign investors often sustain injuries during violent situations, such as riots, revolutions, civil wars, and international armed conflicts. There is a great deal of uncertainty about how effective investment treaty protections are in volatile times, how they relate to other applicable legal frameworks, and how they affect the state security policy and the post-conflict transition to peace. This book explores how foreign investment is protected in times of armed conflict under the investment treaty regime. It does so by combining insights from different areas of international law, including international investment law, international humanitarian law, international human rights law, the law of state responsibility, and the law of treaties. While the protections have evolved over time, with the investment treaty regime providing the strongest legal framework for protecting investors yet, there has been an apparent shift in treaty practice towards safeguarding a state's security interests. Jure Zrilic identifies and analyses the flaws in the existent normative framework, but also highlights the potential that investment treaties have for minimising the devastating effects of armed conflict. The book offers an analytical framework for assessing the investment treaty regime in times of armed conflict, distinguishing between different paradigms and different types of conflicts. Crucially, he argues that a new approach is needed to appropriately balance the competing interests of host states and investors when it comes to investment protection in armed conflicts.
