Just how fascinating the discussion between the disciplines of education law and education policy can be was apparent at the ‘Annual Congress of the European Education Law and Policy Association (ELA) in Rotterdam in December 1997. Although, on this occasion, the option was for an education policy subject, a multidisciplinary approach is always to be preferred. Policy-makers interrogate lawyers; lawyers question scientists from other fields of study and lines of practice. It was, at the same time, a further illustration of how inspiring and productive - in the context of the European Union at any rate - comparative analyses can be for national and international education and social policy. The theme of the 1997 Congress and consequently of this Yearbook, was urban education policy and its legal form as the touchstone of the modern interpretation of individual and social rights. This collection of thought-provoking essays and country reports thus centres on the question: what challenges for education do urban associations represent?

This book takes stock of the state of the question on innovation in a particular area of education and training. But for this it must be noted that economists have appropriated the notion since Schumpeter and have constrained to think innovation in professions of intervention on others as if they were products to be delivered to the customer as quickly and the best (frugal innovation). Here the author brings a nuance and demonstrates the specificity of innovations in "soft" areas, their richness, while drawing the reader to caution and criticism because any innovation is not good in itself: it can Produce adverse effects in the medium and long term. The author proposes two supports for innovation: on the one hand the approach by its most objective evaluation which itself induces an innovation in its evaluation and, on the other hand, an approach to values and therefore to philosophy of the desired future man. A detour on the history of innovation, on its international approaches, on the imaginary investments it is often the object of (with a nuance of utopia) makes it possible to understand why innovation has been a means To drive the reforms and to convince people for a better future.

Problèmes de Conflits de Lois en Matière de Filiation, Jacques Foyer Jacques Foyer, Professor at the University of Paris II, notes in introduction of his course that it can be enlightening to compare the different modern methods of solution of the conflict of laws regarding filiation. The study of the different systems shows that there exist at least three methods to contradict the classic choice-of-law rule. The course is structured around the analysis of these three methods. Firstly, it is the criticism of the rigid character and the unpredictability of the traditional rule that triggers the temptation of a manipulation of the choice of law rule. The author then points out that one could question its abstract and arbitrary character, which leads on the one hand to an attempt to hierarchization, and on the other hand, to a diversification of the choice-of-law rules. Lastly, it is the principle of the foreign law's purpose to govern legal relationships in the same way as the lex fori that is questioned, which leads to its partial elimination to the profit of a more or less systematic application of the territorial law or of the one of the court hearing the action. General Course on Private International Law, Friedrich K. Juenger According to Friedrich Juenger, Professor at the University of California in Davis, the outstanding characteristic of the conflict of laws is the lack of consensus on the discipline's goals and methods. He proposes to put the accent in his course on the events for which public international law must find a solution in order to avoid the constant danger that threatens the discipline: that is, to become a simple academic game. Three examples of reported cases and the kinds of issues they raise are given in the Introduction. Professor Juenger next gives a detailed historical overview of the conflict of laws, from Antiquity to Mancini. In addition, the author presents the emergence of new orthodoxies, or rather proposes to re-examine the traditional doctrines, and points out the advantages of a teleological approach. That allows him to revisit the three cases mentioned in the Introduction. Les Bases éthiques pour le Droit et la Société Perspectives de la Commission indépendante sur les questions humanitaires internationales, Sadruddin Aga Khan Conference of July 30, 1985 Sadruddin Aga Khan, President of the Independent Commission on International Humanitarian Issues, recalls in his course on the ethical bases of law and society that the role of the commission he presides is to remind us of the basic elements of a code of ethics which has the same spiritual significance as that found in all major religions. Lawyers as well as scientists, adds the author, must mobilize their immense resources, bearing in mind that the rule of law should never disregard moral appreciation.

Responding to the international problem identified by the US National Commission on Excellence in Educational Administration, that the field of educational leadership lacks a "good definition", this book reports a collaboration process that produced a practical theory of educative leadership. In offering a holistic theory which deals with the abstract world of ideas and reflection, this volume shows how these ideas are translated into management practice and what happens, or what is likely to happen in such a process. The theory integrates management and evaluation with the philosophical, strategic, political and inspirational services that educative leaders give. It is aimed at lecturers in education administration/management, headteachers, MEd lecturers and students, leadership and management lecturers and students.

Some scholars argue that education systems across the western world are becoming increasingly similar due to the influence of transnational discourses and organizations. Others believe that education is the panacea for all problems of social cohesion. After all, aren't the well-educated usually more tolerant, civically engaged and trusting than the poorly educated? This book critically examines both claims. It finds that western countries still differ markedly on key aspects of their education systems and that these differences reflect distinct political traditions and different responses to a set of competing normative and political principles. The findings further suggest that raising the average education level is unlikely to be an effective strategy for promoting social cohesion. Instead, more promising are policies targeting the opposite ends of the lifelong learning continuum: universalizing pre-school education and care and promoting adult education with a pronounced second chance character.
