Catholic pacifists blame the just war tradition of their Church. That tradition, they say, can be invoked to justify any war, and so it must be jettisoned. This book argues that the problem is not the just war tradition but the unjust war tradition. Ambitious rulers start wars that cannot be justified, and yet warriors continue to fight them. The problem is the belief that warriors do not hold any responsibility for judging the justice of the wars they are ordered to fight. However unjust, a command renders any war “just” for the obedient warrior. This book argues that selective conscientious objection, the right and duty to refuse to fight unjust wars, is the solution. Strengthening the just war tradition depends on a heightened role for the personal conscience of the warrior. That in turn depends on a heightened role for the Church in forming and supporting consciences and judging the justice of particular wars. As Saint Augustine wrote, “The wise man will wage just wars. . . . For, unless the wars were just, he would not have to wage them, and in such circumstances he would not be involved in war at all.”

Killing a person is in general among the most seriously wrongful forms of action, yet most of us accept that it can be permissible to kill people on a large scale in war. Does morality become more permissive in a state of war? Jeff McMahan argues that conditions in war make no difference to what morality permits and the justifications for killing people are the same in war as they are in other contexts, such as individual self-defence. This view is radically at odds with the traditional theory of the just war and has implications that challenge common sense views. Many of his assumptions are still the basis for modern warfare considerations. However, the author suggest that Walzer’s concept of jus in bello (the conduct of war) needs further revision, especially to provide an appropriate notion of combatants. In this respect, the theoretical conception of soldiers will be examined on three different levels of analysis. These include the combatants' contradictory responsibilities in jus ad bellum (the justification for war), jus in bello and the debate on the value of a soldier's life. Firstly, the contradictory role of combatants' responsibilities in jus ad bellum and jus in bello by referring to Graham Parsons' criticism on the dualism of Just War Theory will be outlined. Then, the author elaborates on Walzer's claim that all soldiers are morally equal. The following critical analysis of the value of combatants' lives as individual human beings will further demonstrate the need for a revised perception of combatants in modern warfare and point out why Walzer's assumptions are insufficient. While the role of civilians and their need for protection has developed over time and even restrictions for cruel methods of killing were introduced, the status of soldiers has basically remained the same. In this work the author arugues that striving toward more just warfare also requires reconsidering the highly inhumane status of soldiers in traditional approaches.

To provide a way to understand warfare and debate military conduct, Michael Walzer's Just and Unjust Wars tries to show that civilians and soldiers are not separated by a barrier of violence as we might think, but rather inhabit the same moral world. While this view enables us to question and criticize our leaders during times of war instead of simply claiming ignorance, its success is gained by obscuring certain fundamental boundaries that exist between combatants and noncombatants. By comparing Walzer's just war theory with the existential theories of Jean-Paul Sartre and Martin Heidegger, we can therefore find a more complete picture of what it means to declare war and what it means to engage in combat. This will allow us to see that what separates the soldier from the civilian is our everyday avoidance of death and anything associated with it. Through an investigation into the relationship between death and killing we can then ask, from an existential standpoint, whether we can call any war just so long as our evasion of death also results in our evasion of what soldiers must go through to protect us, thus preventing the soldier from being able to truly return home.
