"In the aftermath of the 9/11 attacks, concerns that terrorists might utilise vessels to transport weaponry, terrorist operatives and/or to finance their activities prompted several international legal developments. This book evaluates the extent to which the international maritime security measures developed following the 9/11 attacks would be likely to prevent the utilisation of vessels to facilitate terrorist activities. It considers the likely effectiveness of the International Ship and Port Facility Security Code for improving vessel and port security, and the 2005 Protocol to the Convention for the Suppression of Unlawful Acts Against Maritime Navigation in facilitating the interdiction of suspected terrorist vessels. It also explains how the US-led Proliferation Security Initiative - a cooperative effort through which participant governments agree to prevent the illicit transfers of Weapons of Mass Destruction and related materials - has provoked debate about the legality of vessel interdictions under the United Nations Convention on the Law of the Sea (the LOSC). After exploring alternative interpretations of the LOSC, and states' self-defence rights under Article 51 of the Charter of the United Nations, it formulates suggested guidelines for the unilateral interdiction of suspected terrorist support vessels in exceptional circumstances. The book also discusses the relevant recommendations by the OECD's Financial Action Taskforce for preventing the financing of terrorism, and the national maritime security legislation for preventing the maritime facilitation of terrorist activities in the United Kingdom and in Australia. The book concludes by emphasising the importance of the continual active implementation of ship, port facility and supply chain security measures, and of further enhancing international cooperation to facilitate vessel interdictions. Over recent decades, it has been widely recognised that terrorist attacks at sea could result in major casualties and cause significant disruptions to the free flow of international shipping. It can be easy to forget the critical role that maritime transport plays in the global economy, but international maritime transportation is still responsible for around 90% of global trade. Protecting the maritime infrastructure essential for this trade from terrorism is a major concern for the international community. This book originates from the NATO Advanced Research Workshop (ARW) Counter-Terrorism Lessons from Maritime Piracy and Narcotics Interdiction, held in Copenhagen, Denmark, in May 2019. Participants in the three-day workshop included policymakers, senior military officers, and academics from NATO member states, international organizations, and two partner nations: Colombia and Israel. Their extensive discussions focused on methods for protecting critical maritime infrastructure, such as ports, supplies, and personnel, from seaborne terrorist attacks. Presentations and roundtables also addressed the human and social factors that contribute to the defense against terrorism in the maritime domain. The book is divided into three sections: organized crime and narcotrafficking; maritime piracy; and terrorism, and aims to bridge the gaps between these three substantive areas of maritime security research. These have remained largely separate areas of research in the past, with the result that valuable maritime security lessons from counter-piracy and counter-narcotics operations have not been fully incorporated into counter-terrorism best practice. Policymakers have become increasingly concerned in recent years about the possibility of future maritime terrorist attacks. Though the historical occurrence of such attacks has been limited, recognition that maritime vessels and facilities may be particularly vulnerable to terrorism has galvanized concerns. In addition, some plausible maritime attacks could have very significant consequences, in the form of mass casualties, severe property damage, and attendant disruption of commerce. Understanding the nature of maritime terrorism risk requires an investigation of threats, vulnerabilities, and consequences associated with potential attacks, as grounded both by relevant historical data and by intelligence on the capabilities and intentions of known terrorist groups. These risks also provide the context for understanding government institutions that will respond to future attacks, and particularly so with regard to the US civil justice system. In principle, civil liability operates to redistribute the harms associated with legally redressable claims, so that related costs are borne by the parties responsible for having caused them. In connection with maritime terrorism, civil liability creates that prospect that independent commercial defendants will be held responsible for damages caused by terrorist attacks. This book explores risks and U.S. civil liability rules as they may apply in the context of these types of attacks.

Unregulated or lesser regulated maritime spaces are ideal theatres of operation and mediums of transportation for terrorists, insurgents and pirates. For more than a decade, the Indian Ocean waters adjoining Somalia have been a particular locus of such activities, with pirates hijacking vessels, and Al Qaeda and Al Shabab elements travelling between Africa and the Arabian Peninsula, operating lucrative businesses and even staging deadly operations at sea. These operations and threats however, remain, by and large, understudied. Responses to the two threats have varied, highlighting the lack of cohesive regional and global institutions with the mandate and the capacity to address them. Those scholarly deliberations on Indian Ocean maritime security focus on piracy and armed robbery at sea, while their terrorist/insurgent counterparts have eluded sustained scrutiny.
