The thirteen essays by Allen Buchanan collected here are arranged in such a way as to make evident their thematic interconnections: the important and hitherto unappreciated relationships among the nature and grounding of human rights, the legitimacy of international institutions, and the justification for using military force across borders. Each of these three topics has spawned a significant literature, but unfortunately has been treated in isolation. In this volume Buchanan makes the case for a holistic, systematic approach, and in so doing constitutes a major contribution at the intersection of International Political Philosophy and International Legal Theory. A major theme of Buchanan's book is the need to combine the philosopher's normative analysis with the political scientist's focus on institutions. Instead of thinking first about norms and then about institutions, if at all, only as mechanisms for implementing norms, it is necessary to consider alternative "packages" consisting of norms and institutions. Whether a particular norm is acceptable can depend upon the institutional context in which it is supposed to be instantiated, and whether a particular institutional arrangement is acceptable can depend on whether it realizes norms of legitimacy or of justice, or at least has a tendency to foster the conditions under which such norms can be realized. In order to evaluate institutions it is necessary not only to consider how well they implement norms that are now considered valid but also their capacity for fostering the epistemic conditions under which norms can be contested, revised, and improved.

Preventive war has a long history in international politics, but until it became an instrumental part of the Bush Doctrine, it was mostly overlooked. This book is an examination of the permissions, prohibitions and obligations found in just war theory, and the moral grounds for laws concerning war. Pronouncing an action or course of actions to be prohibited, permitted or obligatory by just war theory does not thereby establish the moral grounds of that prohibition, permission or obligation; nor does such a pronouncement have sufficient persuasive force to govern actions in the public arena. So what are the moral grounds of laws concerning war, and what ought these laws to be? Adopting the distinction between jus ad bellum and jus in bello, the author argues that rules governing conduct in war can be morally grounded in a form of rule-consequentialism of negative duties. Looking towards the public rules, the book argues for a new interpretation of existing laws, and in some cases the implementation of completely new laws. These include recognising rights of encompassing groups to necessary self-defence; recognising a duty to rescue; and considering all persons neither in uniform nor bearing arms as civilians and therefore fully immune from attack, thus ruling out ‘targeted’ or ‘named’ killings. This book will be of much interest to students of just war theory, ethics of war, international law, peace and conflict studies, and Security Studies/IR in general.

This volume explores the preventive war option in American foreign policy, from the early Cold War strategic problems created by the growth of Soviet and Chinese power, to the post-Cold War fears of a nuclear-armed North Korea, Iraq and Iran. For several decades after the Second World War, American politicians and citizens shared the belief that a war launched in the absence of a truly imminent threat or in response to another’s attack was raw aggression. Preventive war was seen as contrary to the American character and its traditions, a violation of deeply held normative beliefs about the conditions that justify the use of military force. This ‘anti-preventive war norm’ had a decisive restraining effect on how the US faced the shifting threat in this period. But by the early 1990s the Clinton administration considered the preventive war option against North Korea and the Bush administration launched a preventive war against Iraq without a trace of the anti-preventive war norm that was central to the security ethos of an earlier era. While avoiding the sharp partisan and ideological tone of much of the recent discussion of preventive war, Preventive War and American Democracy explains this change in beliefs and explores its implications for the future of American foreign policy.
