Di fronte all’attuale crisi dei principi del diritto penale classico, la dogmatica assurge a ruolo chiave di una ermeneutica che sappia coniugare regole e prassi evitando gli squilibri del ‘mero legalismo’ e della ‘giurisprudenza creativa’. Trait d’union tra fattispecie e tipo, essa postula norme espressive di una precisa politica criminale. Il corredo di tale opzione interpretativa poggia su categorie come l’«offensività» che, grazie alla sua complementare valenza di principio, è dimostrativa di una vera e propria crisi della legalità. Da tale angolazione, l’indagine utilizza l’arco funzionale della necessaria lesività quale canone di politica criminale impositivo di una diretta proporzione tra grado di anticipazione della tutela e livello di determinatezza. Il dialogo con il parametro di ragionevolezza è, invece, volto a sondare la legittimazione dell’area di rischio-penale rispetto alle derive del ‘precauzionismo’. Le potenzialità dell’offensività come criterio interpretativo-applicativo sono testate sulle fattispecie di «abuso d’ufficio» (art. 323 c.p.) e «autoriciclaggio» (art. 648-ter.1 c.p.), dove il ricorso a meccanismi di stampo oggettivistico assicura un percorso esegetico epistemologicamente verificabile. Interpolando i momenti di lesività interni al modello legale vengono valorizzate categorie trascurate dal formante giurisprudenziale: il ‘nesso di prevenzione’ imposto dalla causalità normativa (nell’abuso d’ufficio) e la ‘destinazione’ in «attività economiche» dell’impiego decettivo (nell’autoriciclaggio) focalizzano l’attenzione dell’operatore sul ‘disvalore’ dell’illecito penale. Lo scopo è quello di stabilizzare la struttura della fattispecie e ricavare dalla sua geometria la corretta soluzione applicativa.

In Why People Cooperate, Tom Tyler challenges the decades-old notion that individuals within groups are primarily motivated by their self-interest.
