"El derecho internacional, o derecho de gentes, es el nombre de un conjunto de normas que —de acuerdo con la definición usual— reglan la conducta de los Estados en sus relaciones mutuas. A estas normas se las denomina derecho. Si hablamos de derecho en la vida diaria, pensamos en el derecho nacional o interno, el derecho que rige dentro del Estado. Pero el llamado derecho internacional, las normas que rigen las relaciones entre los Estados, ¿es derecho en el mismo sentido que el derecho nacional o interno? La respuesta a esta pregunta depende de la definición del concepto de derecho. Cualquier intento de definir un concepto debe partir de un cierto uso del lenguaje, del significado corriente de la palabra con la que nos proponemos designar el concepto. Uno debe ver si los fenómenos sociales llamados «derecho» presentan una característica común que los distinga de otros fenómenos sociales de clase similar, característica que sea lo suficientemente significativa como para constituir un concepto general para la comprensión racional de la vida social.
