In any country where there is a Bill of Rights, constitutional rights reasoning is an important part of the legal process. As more and more countries adopt Human Rights legislation and accede to international human rights agreements, and as the European Union introduces its own Bill of Rights, judges struggle to implement these rights consistently and sometimes the reasoning behind them is lost. Examining the practice in other jurisdictions can be a valuable guide. Robert Alexy's classic work reconstructs the reasoning behind the jurisprudence of the German Basic Law and in doing so provides a theory of general application to all jurisdictions where judges wrestle with rights adjudication. In considering the features of constitutional rights reasoning, the author moves from the doctrine of proportionality, procedural rights and the structure and scope of constitutional rights, to general rights of liberty and equality and the problem of horizontal effect. A postscript written for the English edition considers critiques of the Theory since it first appeared in 1985, focusing in particular on the discretion left to legislatures and in an extended introduction the translator argues that the theory may be used to clarify the nature of legal reasoning in the context of rights under the British Constitution.

Principios jurídicos implícitos es una compilación de ocho ensayos sobre cuestiones filosófico-jurídicas analizadas a través de problemas concretos de derecho penal, civil y constitucional de Argentina y España. A partir del positivismo lógico de Carlos Alchourrón y Eugenio Bulygin (de quienes el autor es discípulo), se efectúan reflexiones sobre los principios jurídicos en general, los principios implícitos en particular, y la relación entre sistemas de reglas y sistemas de principios. Alonso confronta las críticas de Ronald Dworkin al positivismo jurídico en cuanto a que el positivismo sería incapaz -por sus compromisos epistemológicos- de dar cuenta de la existencia y aplicación de los principios implícitos en la teoría y la práctica jurídica. Para ello, Alonso conceptualiza dos tesis centrales del positivismo jurídico, a saber: a) la tesis de las fuentes sociales del derecho y b) la tesis de la separación entre derecho y moral; a partir de esas dos tesis se explica cómo puede darse cuenta de principios implícitos desde el positivismo jurídico con utilización de metodologías inductivas o abductivas. El autor articula una relación entre sistemas de reglas (formuladas o derivadas) y sistemas de principios (explícitos o implícitos) a partir de la tesis de la coherencia de Neil MacCormick, distinguiendo tres funciones de la coherencia jurídica: una función descriptiva y dos funciones normativas. Además, se expone una estructura lógica de los principios jurídicos sobre la base de la lógica de preferencias, como una forma alternativa a la clásica conceptualización de la estructura lógica de los principios jurídicos como normas condicionales debilitadas, conceptualización que Alonso critica en la versión de Robert Alexy. Finalmente, se desarrolla el diagrama de coherencia, que es el gráfico que permite visualizar las relaciones de coherencia internas de un sistema de reglas de acuerdo con los parámetros determinados por los principios que rigen en dicho sistema.
