Como su propio título indica, el presente estudio pretende realizar un análisis crítico de la máxima prior tempore potior iure, pretendida verdad incontrovertible, cuestionada, a la postre, por los hechos. Se pone de relieve, al respecto, la aparición de la dicha máxima, tal y como hoy la conocemos, en el Medievo, que no en Roma, poniéndose de relieve, también, su escaso o nulo funcionamiento en clave de doble venta o de concurrencia y prelación de créditos, lo cual permite pensar en su falsedad o, cuando menos, en su relatividad, pensamiento que se puede extender, por otra parte y como regla general, a las reglas, máximas, brocardos, axiomas y principios diversos. El autor, Carlos Rogel Vide, catedrático emérito de la Universidad Complutense de Madrid, colabora activamente, desde 1999, con la Editorial Reus, dirigiendo la Revista General de Legislación y Jurisprudencia así como diversas colecciones entre las que cabe señalar la Jurídica General, la de Derecho Español Contemporáneo, la Biblioteca Iberoamericana de Derecho y la de Propiedad Intelectual. This book provides a thorough introduction to Roman property law by means of "cases," consisting of brief excerpts from Roman juristic sources in the original Latin with accompanying English translations. The cases are selected and grouped so as to provide an overview of each topic and an orderly exposition of its parts. To each case is attached a set of questions that invite the reader to, e.g., clarify ambiguities in the jurist's argument, reconcile one holding with another, supply missing but necessary facts to account for the holding, and/or engage in other analytical activities. The casebook also illustrates the survival and adaptation of elements of Roman property law in the modern European civil codes, especially the three most influential of those codes: the General Civil Code of Austria (Allgemeines Bürgerliches Gesetzbuch), the German Civil Code (Bürgerliches Gesetzbuch), and the Civil Code of Switzerland (Zivilgesetzbuch). All code excerpts are accompanied by English translations. By comparing and contrasting how the codes have adopted, adapted, or rejected an underlying Roman rule or concept, it is possible for the reader to observe the dynamic character and continuing life of the Roman legal tradition. To facilitate comparison with corresponding rules and concepts in the English common law tradition, additional texts and questions prepared by the translator will be mounted on an accompanying website, www.oup.com/us/romanpropertylaw.

The book provides rule-by-rule commentaries on European contract law (general contract law, consumer contract law, the law of sale and related services), dealing with its modern manifestations as well as its historical and comparative foundations. After the collapse of the European Commission's plans to codify European contract law it is timely to reflect on what has been achieved over the past three to four decades, and for an assessment of the current situation. In particular, the production of a bewildering number of reference texts has contributed to a complex picture of European contract laws rather than a European contract law. The present book adopts a broad perspective and an integrative approach. All relevant reference texts (from the CISG to the Draft Common European Sales Law) are critically examined and compared with each other. As far as the acquis commun (ie the traditional private law as laid down in the national codifications) is concerned, the Principles of European Contract Law have been chosen as a point of departure. The rules contained in that document have, however, been complemented with some chapters, sections, and individual provisions drawn from other sources, primarily in order to account for the quickly growing acquis communautaire in the field of consumer contract law. In addition, the book ties the discussion concerning the reference texts back to the pertinent historical and comparative background; and it thus investigates whether, and to what extent, these texts can be taken to be genuinely European in nature, ie to constitute a manifestation of a common core of European contract law. Where this is not the case, the question is asked whether, and for what reasons, they should be seen as points of departure for the further development of European contract law.
