English summary: Stephan Rixen examines the highly-regulated health care market, a branch which has been greatly influenced by the standards imposed by public law and in which the spheres of freedom given to service performers (doctors, hospitals, pharmacies, pharmaceutical companies, physiotherapists, midwives etc.) have been restricted considerably for social reasons. In this work, the author develops new constitutional and administrative law distinctions which strengthen the fundamental rights of health care professionals. He opts for a specific legal and economic approach which defines the implementation of social health care policies as an integral part of economic regulation by public law. Es scheint so, als solle eines der letzten Refugien der Rechtsordnung, das einer anderen, solidarischen Eigenlogik verpflichtet ist, erobert werden: die gesetzliche Krankenversicherung (GKV). Ihre Funktion kann sie nur erfullen, weil es im Auftrag der Krankenkassen handelnde sog. Leistungserbringer gibt (Arzte, Krankenhauser, Apotheken, pharmazeutische Unternehmen, Physiotherapeuten, Hebammen etc.), die Patienten mit Gesundheitsleistungen versorgen. Folge ist ein von Normen des offentlichen Rechts gepragter hochregulierter Gesundheitsmarkt, auf dem die Freiheitsraume von Leistungserbringern aus sozialen Grunden stark reduziert werden. Ausgehend von einer Neujustierung des grundrechtlichen Schutzes der Gesundheitsberufsfreiheit rekonstruiert Stephan Rixen Strukturen und Details im System der Leistungserbringung der GKV. Das gewahrleistungsstaatliche Sozialstaatsprinzip wird auf seine Bedeutung als strikt abhangige Variable des Freiheitsschutzes zuruckgefuhrt. Dabei erweist sich das Leistungserbringerrecht zugleich als spezifisches Verwaltungsrecht, als besondere Materie des europaisierten offentlichen Wirtschaftsrechts und als offentliches Sozialwirtschaftsrecht.

This book traces the origins of the German welfare state.
