Questions regarding how to improve the transitional phase from prison to life in society after release have gained major importance in the last decade in criminal policy. All over the world release preparation and resettlement practice are discussed with the aim to reduce negative effects of imprisonment and re-offending rates. Small and large reforms aiming at the improvement of release processes and reintegration strategies have taken place in many European states. This book describes the current European landscape of prisoner resettlement and brings together the results and ideas of leading European academic experts with the ambition of furthering national, European and international reform debates. This book presents national reports about resettlement processes and structures in 20 European countries: written by national scholars, these reports reveal important actors in resettlement processes as well as political decisions about the role of the communities in "taking the prisoners back", or the use of early release as a strategy to motivate the released prisoner to enter into a future without crime. Thematic chapters then concentrate on several aspects of prisoner resettlement that are of importance across borders: ethical, legal and practical challenges are discussed with a view on European developments, and theoretical frameworks of prisoner resettlement are used to develop comprehensive perspectives for future reform debates. The book serves as a fundamental source for researchers, politicians and practitioners in the field of prison and probation reform and practice. It is also useful in the field of social work, in so far that the analyses confirm that prisoner resettlement is not just a problem of criminal, but also of social justice. Sustainable reforms need the will of and good cooperation between all responsible actors and organizations from the justice, social, health and welfare sectors, as well as from society as a whole in the consent for taking released prisoners back.

Forced Mobility of EU Citizens is a critical evaluation from an empirical perspective of existing practices of the use of transnational criminal justice instruments within the European Union. Such instruments include the European Arrest Warrant (EAW), prisoner transfer procedures and criminal law-related deportations. The voices and experiences of people transferred across internal borders of the European Union are brought to the fore in this book. Another area explored is the scope and value of EU citizenship rights in light of cooperation not just between judicial authorities of EU Member States, but criminal justice systems in general, including penitentiary institutions. The novelty of the book lays not only in the fact that it brings to the fore a topic that so far has been under-researched, but it also brings together academics and studies from different parts of Europe – from the west (i.e. the expelling countries) and the east (the receiving countries, with a special focus on two of the jurisdictions most affected by these processes – Poland and Romania). It therefore exposes processes that have so far been hidden, shows the links between sending and receiving countries, and elaborates on the harms caused by those instruments and the very idea of ‘justice’ behind them. This book also introduces a new element to deportation studies as it links to them the institution of the European Arrest Warrant and EU law transfers targeting prisoners and sentenced individuals. With a combination of legal, criminological, and sociological perspectives, this book will be of great interest to scholars and students with an interest in EU law, criminal law, transnational criminal justice, migration/immigration, and citizenship. Over the last few decades, the prison populations in European countries have grown and their profiles have changed. There are more than 100,000 foreign prisoners in European countries. Their numbers vary greatly from country to country, but the average percentage of foreigners in the total European prison population is over 20%. Why are foreigners over-represented in European prison populations? Who are they and on what grounds are they held in detention? Are foreign prisoners more vulnerable due to language difficulties, cultural differences, and their distance from relatives? Are they being socially excluded? Is their treatment and legal position different from other prisoners? And, how are national prison systems and other authorities addressing this issue? Funded by the European Commission, this extensive study - developed within the framework of the EU program "Social Exclusion" - offers an answer to the questions stated above. With this, a distinction is made between foreigners who are detained for committing a crime - or are suspected of one - and foreigners whose deprivation of liberty is based on migration law. Originally published as a two volume set in 2007, this comprehensive single volume reprint contains country reports of twenty-five EU Member States, as well as six reports of organizations which contributed to the research. The first chapter presents a comparative overview with conclusions and recommendations. At the end, a detailed bibliography will be given which includes relevant websites and legal documents.
