Rapid technological change, the advent of Big Data, and the creation of society-wide government surveillance programs have transformed the accessibility of highly personal information; these developments have highlighted the ambiguous treatment of privacy and personal intimacy. National legal systems vouchsafe and define "privacy," and its first cousin "dignity," in different ways that reflect local legal and cultural values. Yet, in an increasingly globalized world, purely local protection of privacy interests may prove insufficient to safeguard effectively fundamental autonomy interests - interests that lie at the core of self-definition, personal autonomy, and freedom. Privacy Revisited articulates the legal meanings of privacy and dignity through the lens of comparative law, and argues that the concept of privacy requires a more systematic approach if it is to be useful in framing and protecting certain fundamental autonomy interests. The book begins by providing relevant, and reasonably detailed, information about both the substantive and procedural protections of privacy/dignity in the U.S., Canada, South Africa, the United Kingdom, and among Council of Europe member states. Second, the book explores the inherent tension between affording significant legal protection to the right of privacy (or human dignity) and securing expressive freedoms, notably including the freedom of speech and of the press. The author then posits that the protection of privacy helps to illuminate some of the underlying social and political values that lead the U.S. to fail to protect privacy as reliably or as comprehensively as other liberal democracies. Finally, the book establishes that although privacy and speech come into conflict with some regularity, it is both useful and necessary to start thinking about the important ways in which both rights are integral to the maintenance of democratic self-government.

'I Hope I Don't Intrude' takes its title from the catch-phrase of the eponymous hero of the 1825 play Paul Pry, which was an immense success on the London stage and then rapidly in New York and around the English-speaking world. It tackles the complex, multi-faceted subject of privacy in nineteenth-century Britain by examining the way in which the tropes, language, and imagery of the play entered public discourse about privacy in the rest of the century. The volume is not just an account of a play, or of late Georgian and Victorian theatre. Rather it is a history of privacy, showing how the play resonated through Victorian society and revealed its concerns over personal and state secrecy, celebrity, gossip and scandal, postal espionage, virtual privacy, the idea of intimacy, and the evolution of public and private spheres. After 1825 the overly inquisitive figure of Paul Pry appeared everywhere - in songs, stories, and newspapers, and on everything from buttons and Staffordshire pottery to pubs, ships, and stagecoaches - and 'Paul-Prying' rapidly entered the language. Security concerns have mushroomed. Increasingly numerous areas of life are governed by security policies and technologies. Security Unbound argues that when insecurities pervade how we relate to our neighbours, how we perceive international politics, how governments formulate policies, at stake is not our security but our democracy. Security is not in the first instance a right or value but a practice that challenges democratic institutions and actions. We are familiar with emergency policies in the name of national security challenging parliamentary processes, the space for political dissent, and fundamental rights. Yet, security practice and technology pervade society heavily in very mundane ways without raising national security crises, in particular through surveillance technology and the management of risks and uncertainties in many areas of life. These more diffuse security practices create societies in which suspicion becomes a default way of relating and governing relations, ranging from neighbourhood relations over financial transactions to cross border mobility. Security Unbound demonstrates that governing through suspicion poses serious challenges to democratic practice. Some of these challenges are familiar, such as the erosion of the right to privacy; others are less so, such as the post-human challenge to citizenship. Security unbound provokes us to see that the democratic political stake today is not our security but preventing insecurity from becoming the organising principle of political and social life.

The concept of privacy has long been confused and incoherent. The right to privacy has been applied promiscuously to an alarmingly wide-ranging assortment of issues including free speech, political consent, abortion, contraception, sexual preference, noise, discrimination, and pornography. The conventional definition of privacy, and attempts to evolve a 'privacy-as-a-fence' approach, are unable to deal effectively with the technological advances that have significantly altered the way information is collected, stored, and communicated. Social media such as Facebook pose searching questions about the use and protection of personal information and reveal the limits of conceiving the right to privacy as synonymous with data protection. The recent European Union's GDPR seeks to enforce greater protection of personal information, but the overlap with privacy has further obscured its core meaning. This book traces these troubling developments, and seeks to reveal the essential nature of privacy and, critically, what privacy is not.
