Obwohl die private Kartellrechtsdurchsetzung in den letzten zwei Jahrzehnten erheblich an Bedeutung gewonnen hat, ist der Rechtsschutz in Deutschland noch weit davon entfernt – ähnlich wie im US-amerikanischen Antitrustrecht – eine der sichersten Waffen zur wirksamen Durchsetzung des Kartellverbots zu sein. Dem private enforcement fehlt es trotz gesetzgeberischer Aktivitäten nach wie vor an der gewünschten Schlagkraft. Vor diesem Hintergrund setzt sich die Arbeit mit der Beweislast im Kartellzivilprozess auseinander.
