Die zumeist nationale Fragmentierung des Handelsrechts wird seit jeher als Hemmnis fur den internationalen Handel verstanden. Neben staatlichen Bemuhungen, Rechtseinheit durch volkerrechtliche Vertrage zu erzeugen, haben sich auch private Akteure, wie beispielsweise die Internationale Handelskammer in Paris, durch die Schaffung eigener nichtstaatlicher Regelwerke dem Ziel der Rechtsvereinheitlichung auf dem Gebiet des internationalen Handelsrechts verschrieben. Die Einordnung solcher Regelwerke stellt die Rechtsquellenlehre vor Herausforderungen. Insa Stephanie Jarass arbeitet den Begriff des "privaten Einheitsrechts" als eigenstandige dogmatische Kategorie heraus. Ausgehend von den Funktionsbedingungen privaten Einheitsrechts definiert sie dessen Tatbestand und Rechtsfolgen. Grundlage hierfur ist eine empirische Analyse der englischen und deutschen Rechtsprechung zu ausgewahlten Regelwerken (Incoterms, Einheitliche Richtlinien und Gebrauche fur Dokumentenakkreditive, beide herausgegeben von der Internationalen Handelskammer sowie die Grundregeln fur Internationale Handelsvertrage von UNIDROIT).Die Arbeit wurde mit der Otto-Hahn-Medaille 2017 der Max-Planck-Gesellschaft ausgezeichnet.

The law applicable to contractual and non-contractual obligations in cross-border civil and commercial matters in the European Union (EU) is the remit of the so-called Rome I and II Regulations that entered into force in 2009, supplemented by the Rome III Regulation of 2012 dealing specifically with divorce and legal separation. This article-by-article commentary – now updated to its third edition – has become a cornerstone resource in handling European cases involving conflict of laws. The occasion for publishing a third edition is that several landmark judgments on the conflict of laws have been recently rendered both by the Court of Justice of the EU and by domestic courts. Moreover, with Brexit, one of the largest European states will enter into a new form of relationship with the EU, which will specifically impact the conflict of laws. The effects of these major developments are reflected throughout the new edition’s extensively revised article-by-article commentary. The idea of national codification is advancing on a global scale in conflict of laws. A large number of legislative projects dealing with codifying and modernizing private international law, both on the national and the supranational level, have been launched in the past few years. Among such recent initiatives, the advances taken by the European and the Japanese legislators are particularly reflecting these developments. On January 1, 2007, the new Japanese 'Act on General Rules for Application of Laws' entered into force replacing the outdated conflict of laws statute of 1898. This major reform finds its parallels in the current efforts of the European Union to create a modern private international law regime for its member states.This volume presents the first comprehensive analysis of the new Japanese private international law available in any western language and contrasts it with corresponding European developments. Most of the contributors from Japan are scholars who were actively involved in and responsible for preparing the new Act. All of them are renowned experts in the field of private international law. Mascha Hesse geht diesem Spannungsverhältnis nach und untersucht, inwiefern das staatliche Recht im europäischen Rechtsraum den AGB-spezifischen Gefahren entgegenwirkt. Hierzu nimmt sie eine umfassende Analyse der deutschen Rechtsprechung der letzten 30 Jahre vor und legt dar, welchen Klauseln dort aus welchen Gründen die Anerkennung versagt wird. Sie vergleicht anschließend erstmals die Kontrolle von Rechtswahl-, Gerichtsstands- und Schiedsklauseln untereinander und entwickelt mithilfe des europäischen Justizgewährungsanspruchs ein Modell für eine kohärentere Kontrolle.
