Das Privilegium Minus hat als frühestes österreichisches Rechtsdokument besondere Bedeutung für die österreichische Rechtsgeschichte. Als Zugeständnis an Heinrich II. in Verwirklichung der Heerschildordnung gedacht, diente das Privilegium minus hauptsächlich zur Festigung der Stellung der Babenberger in Österreich und insbesondere zur Beibehaltung der (fürstlichen) Stellung Heinrichs II. ... PRIVILEGIUM MAIUS Beim Privilegium maius handelt es sich um eine von Herzog Rudolf IV. in Auftrag gegebene Fälschung. Der Anlass dafür ist strittig, man vermutet aber, dass der Grund für die Fälschung die Missachtung Österreichs in der Goldenen Bulle von 1356 gewesen sein könnte. Zumal Österreich nicht zum Kreis der Kurfürsten gehörte, kamen den Habsburgern die in der Goldenen Bulle festgelegten Privilegien nicht zu. Rudolf IV., zu diesem Zeitpunkt erst 19 Jahre alt, dürfte diese Zurücksetzung dermaßen verärgert haben, dass er versuchte durch eine gefälschte Urkundensammlung ein Machtgleichgewicht herzustellen. ...

Otto Brunner contends that prevailing notions of medieval social and constitutional history had been shaped by the nineteenth-century nation state and its "liberal" order. Whereas a sharp distinction between the public and the private might be appropriate to descriptions of contemporary society, such a dichotomy could not be projected back onto the Middle Ages. Focusing particularly on forms of lordship in late medieval Austria, Brunner found neither a "state" in the modern sense nor any distinction between the public and private spheres. Behind the apparent disorder of late medieval political life, however, Brunner discovered a coherent legal and constitutional order rooted in the the rights and obligations of noble lordship. In carefully reconstructing this order, Brunner's study weaves together social, legal, constitutional, and intellectual history.

In 1358/59, Duke Rudolf IV of Austria presented his father-in-law Emperor Karl IV with a series of forgeries with the "Privilegium maius" as a central document, which granted the Austrian princes special privileges, law applicable in the 15th century and in the 19th century have finally been exposed as a forgery. The volume gathers the contributions of a conference on this topic that deals with the political and ceremonial context of the forgeries, their diplomatic and paleographic analysis, their confirmation by Emperor Friedrich III, their use in modern times, their traces in art, history dedicate themselves to their research and investigation using scientific methods.
