Excerpt from Judgments of the Privy Council on Appeals From India, Vol. 3 The decisions of the Judicial Committee of Her Majesty's Privy Council, in cases heard on appeal from the Courts of British India, are at present in a great measure unknown to and beyond the reach of a great majority of the Judges of our Courts. From the year 1836 regular reports of the decisions on Indian Appeals have been published by Mr. Moore. But the earlier volumes of this series are not to be procured without great difficulty (the first volume alone, I believe, not being procurable for even Rs. While the high price of all of them is an obstacle to their wide circulation. In 1855 the Privy Council first began to print their Indian. Judgments, and I have been furnished with the whole series of these printed judgments from that time to the presents I have also been furnished with the earlier judgments commencing from 1831 to 1834, as published in what is known as the Folio Edition of the Privy Council Cases, a still more inaccessible work than Moore's Reports. From these materials I propose to reprint the whole of the judgments in a single volume, with carefully prepared marginal notes, and a copious Index, so that, in a convenient form for reference, the judgments of the highest tribunal will be brought within reach of every local Court. By the Folio Edition of the Privy Council Cases above referred to, were meant the printed cases in appeals which were bound up together with the judgments. A complete set of these was kept up in the Library of the late Sudder Court at Calcutta. Excerpt from A Digest of Indian Law Cases, Vol. 1 of 6: Containing High Court Reports, 1862-1900, and Privy Council Reports of Appeals From India, 1836-1900, With an Index of Cases; Compiled Under the Orders of the Government of India; A-C Ince the issue of the first Digest, which included the decisions of the High Courts and Privy Council down to 1886, the Author brought out three separate volumes containing the cases from 1887 -1889, 1890 - 1893, and 1894 - 1897, respectively. The present edition is a consolidation of the previous Digests, with the addition of the rulings from 1898 - 1900 inclusive. Its bulk has consequently increased to a very considerable extent. A reference to the Table of Reports will show that the number of volumes of Reports digested is 24-1, as compared with 166 volumes digested in the first edition. The first four numbers of the Calcutta Weekly Notes have also been incorporated, as frequent reference is made to them in the Calcutta High Court. An idea of the increase of the size of this edition may be gained from a comparison of the number of volumes and columns of the two editions. Whereas the first Digest comprised five volumes including the Table of Cases, the present one is made up of five volumes of the Digest alone, and has a separate volume for the Table of Cases. In the former publication, Volume I contained the letters A - D and consisted of columns; the present Volume I contains A C only, and runs into columns. In order to keep down the size of the. Volumes, the Author has been obliged in several places to omit lists of cases from cross references, thereby avoiding repetition, without, however, impairing the value of the work. The scheme and arrangement of the Digest remains the same, but Act XXVI of 1867, which was put under the Stamp Acts, has been transposed to Court Fees, and Bombay Actl of 1865 now appears under the heading Bombay Survey and Settlement Act I of Many separate minor headings have been brought under more general headings, and several sub-headin gs have been somewhat verbally altered. The vernacular terms and expressions which are scattered throughout the Reports are now printed in roman letters instead of italics, and some uniformity in their spelling has been observed. This book explores the legal culture of the Parsis, or Zoroastrians, an ethnoreligious community unusually invested in the colonial legal system of British India and Burma. Rather than trying to maintain collective autonomy and integrity by avoiding interaction with the state, the Parsis sank deep into the colonial legal system itself. From the late eighteenth century until India's independence in 1947, they became heavy users of colonial law, acting as lawyers, judges, litigants, lobbyists, and legislators. They de-Anglicized the law that governed them and enshrined in law their own distinctive models of the family and community by two routes: frequent intra-group litigation often managed by Parsi legal professionals in the areas of marriage, inheritance, religious trusts, and libel, and the creation of legislation that would become Parsi personal law. Other South Asian communities also turned to law, but none seems to have done so earlier or in more pronounced ways than the Parsis.
