Esta obra reúne varias contribuciones derivadas de las XXXIX Jornadas Internacionales de Derecho Penal, realizadas en la Universidad Externado de Colombia en agosto de 2017. El libro Reflexiones jurídicas sobre la Jurisdicción Especial para la Paz es el producto de una investigación realizada de manera conjunta entre profesores de los departamentos de Derecho Penal y Criminología y Derecho Constitucional de la Universidad Externado de Colombia, en la cual, luego de una serie de discusiones sobre los principales problemas teórico-prácticos de la nueva Jurisdicción Especial para la Paz, decidimos que era indispensable abordar desde una perspectiva académica los principales retos que representaba esta jurisdicción en el derecho colombiano. Así, se consideró que era indispensable: 1) realizar un análisis constitucional sobre los fundamentos, las características y las fuentes del derecho que resultan aplicables a los procesos que se adelantan en la JEP. los cuales responden a una lógica diferente a la que se usa en la justicia ordinaria; 2) estudiar los ámbitos de aplicación de la ley en la JEP, esto es, establecer a quién se aplica la JEP —ámbito personal— y a qué hechos, delimitados por el lugar —ámbito espacial— y tiempo —ámbito temporal— en el que ocurrieron: 3) delito político y delitos conexas. a efectos de determinar los casos de aplicación de las figuras de terminación del proceso y flexibilización del derecho que contempló el Acuerdo de Paz y, finalmente, 4) estudiar los diferentes aspectos procesales de los procedimientos aplicables en la JEP, entre ellos, las medidas cautelares, la priorización y selección, los principios y características del procedimiento. las clases de procesos aplicables por cada Sala de Justicia y Sección del Tribunal, entre otras importantes temáticas.
