Legal Priorities In Air Transport written by Ruwantissa Abeyratne and has been published by Springer this book supported file pdf, txt, epub, kindle and other format this book has been release on 2019-05-27 with Law categories.
Against the backdrop of enormous technological strides, this book argues that the air transport industry must be constantly vigilant in its efforts to employ a legal regime that is applicable to the aeronautical and human aspects of the carriage by air of persons and goods. In this regard, safety and security are of the utmost importance, both in terms of safe air navigation and the preservation of human life. Although the International Civil Aviation Organization (ICAO) addresses legal issues through its Legal Committee, many emerging issues that urgently require attention lie outside the Committee’s purview. This book analyzes in detail the items being considered by ICAO’s Legal Committee, considers the legal nature of ICAO, and discusses whether or not ICAO’s scope should be extended. Since the limited issues currently addressed by ICAO do not reflect the rapidly changing realities of air transport, the book also covers a broad range of key issues outside the parameters set by ICAO, such as: the need to teach air law to a new generation of aviation professionals; combating cyber-crime and cyber-terrorism; the regulation of artificial intelligence; traveller identification; interference with air navigation; human trafficking; unruly passengers; climate change; air carrier liability for passenger death or injury; Remotely Piloted Aircraft Systems (drones); and the cabin crew and their legal implications.

This updated edition of a well-known comprehensive analysis of the criminalization of cyberattacks adds important new guidance to the legal framework on cybercrime, reflecting new legislation, technological developments, and the changing nature of cybercrime itself. The focus is not only on criminal law aspects but also on issues of data protection, jurisdiction, electronic evidence, enforcement, and digital forensics. It provides a thorough analysis of the legal regulation of attacks against information systems in the European, international, and comparative law contexts. Among the new and continuing aspects of cybersecurity covered are the following: the conflict of cybercrime investigation and prosecution with fundamental rights to privacy and freedom of expression; the 2016 Directive on security of network and information systems (NIS Directive); the General Data Protection Regulation (GDPR); the role of national computer security incident response teams (CSIRTs); the European Union (EU) response to new technologies involving payment instruments, including virtual currencies and digital wallets; the EU Commission’s legislative proposals to enhance cross-border gathering of electronic evidence; internet service providers’ role in fighting cybercrime; measures combatting identity theft, spyware, and malware; states and legal persons as perpetrators of cybercrime; and the security and data breach notification as a compliance and transparency tool. Technical definitions, case laws, and analysis of both substantive law and procedural law contribute to a comprehensive understanding of cybercrime regulation and its current evolution in practice. Addressing a topic of growing importance in unprecedented detail, this new edition of a much-relied-upon resource will be welcomed by professionals and authorities dealing with cybercrime, including lawyers, judges, academics, security professionals, information technology experts, and law enforcement agencies.

The study analyses the provisions of article 10 of the European Convention of Human Rights, which protects freedom of expression, in the context of the Internet society. Recent landmark ECHR and ECJ judgments, useful to explain the peculiar mechanism of protection of freedom of expression in the field, are examined in the text. A special attention is given to the ECHR Grand Chamber Delfi v. Estonia judgment, delivered in 2015, which clearly set the position of the Information service providers, their powers and duties to filter and block illegal data, and their responsibility for defamation brought by Internet users.

Ensuring online safety has become a topic on the regulatory agenda in many Western societies. However, regulating for online safety is far from easy, due to the wide variety of national and international, private and public actors and stakeholders that are involved. When regulating online risks for children it is important to strike the right balance between protection against harms on the one hand and safeguarding their fundamental freedoms and rights on the other. The authors in this book attempt to grapple with precisely this theme: striking the right balance between ensuring safety for children on the internet while at the same time enabling them to experiment, to learn, to enrich their lives, to acquire skills and to have fun using this global network. The authors come from various scientific disciplines, ranging from law to social science and from media studies to philosophy. This means that the book provides the reader with both empirical and theoretical/conceptual chapters and sheds a multi-disciplinary light on the complex topic of regulating online safety for children.
