Reconsidering Constitutional Formation Ii Decisive Constitutional Normativity written by Ulrike Müßig and has been published by this book supported file pdf, txt, epub, kindle and other format this book has been release on 2020-10-08 with Political Science categories.

This second volume of ReConFort, published open access, addresses the decisive role of constitutional normativity, and focuses on discourses concerning the legal role of constitutional norms. Taken together with ReConFort I (National Sovereignty), it calls for an innovative reassessment of constitutional history drawing on key categories to convey the legal nature of the constitution itself (national sovereignty, precedence, justiciability of power, judiciary as constituted power). In the late 18th and early 19th centuries, constitutional normativity began to complete the legal fixation of the entire political order. This juridification in one constitutional text resulted in a conceptual differentiation from ordinary law, which extends to alterability and justiciability. The early expressions of this 'new order of the ages' suggest an unprecedented and irremediable break with European legal tradition, be it with British colonial governance or the French ancien régime. In fact, while the shift to constitutions as a hierarchically 'higher' form of positive law was a revolutionary change, it also drew upon old liberties. The American constitutional discourse, which was itself heavily influenced by British common law, in turn served as an inspiration for a variety of constitutional experiments - from the French Revolution to Napoleon's downfall, in the halls of the Frankfurt Assembly, on the road to a unified Italy, and in the later theoretical discourse of twentieth-century Austria. If the constitution states the legal rules for the law-making process, then its Kelsian primacy is mandatory. Also included in this volume are the French originals and English translations of two vital documents. The first - Emmanuel Joseph Sieyès' Du Jury Constitutionnaire (1795) - highlights an early attempt to reconcile the democratic values of the French Revolution with the pragmatic need to legally protect the Revolution. The second - the 1812 draft of the Constitution of the Kingdom of Poland - presents the 'constitutional propaganda' of the Russian Tsar Alexander I to bargain for the support of the Lithuanian and Polish nobility. These documents open new avenues of research into Europe's constitutional history: one replete with diverse contexts and national experiences, but above all an overarching motif of constitutional decisiveness that served to complete the juridification of sovereignty. The Boundaries Of Europe written by Pietro Rossi and has been published by Walter de Gruyter GmbH & Co KG this book supported file pdf, txt, epub, kindle and other format this book has been release on 2015-04-24 with Political Science categories.

Europe’s boundaries have mainly been shaped by cultural, religious, and political conceptions rather than by geography. This volume of bilingual essays from renowned European scholars outlines the transformation of Europe’s boundaries from the fall of the ancient world to the age of decolonization, or the end of the explicit endeavor to “Europeanize” the world. From the decline of the Roman Empire to the polycentrism of today’s world, the essays span such aspects as the confrontation of Christian Europe with Islam and the changing role of the Mediterranean from “mare nostrum” to a frontier between nations. Scandinavia, eastern Europe and the Atlantic are also analyzed as boundaries in the context of exploration, migratory movements, cultural exchanges, and war. The Boundaries of Europe, edited by Pietro Rossi, is the first installment in the ALLEA book series Discourses on Intellectual Europe, which seeks to explore the question of an intrinsic or quintessential European identity in light of the rising skepticism towards Europe as an integrated cultural and intellectual region.

Innovation And Transition In Law Experiences And Theoretical Settings written by and has been published by Dykinson this book supported file pdf, txt, epub, kindle and other format this book has been release on with categories.

This book features a discussion on the modernisation of law and legal change, focusing on the key concepts of innovation" and "transition". These concepts both appear to be relevant and poorly defined in contemporary legal science. A critical reflection on the heuristic value of these categories seems appropriate, particularly considering their dyadic value. While innovation is increasingly appearing in the present day as being the category in which one looks at the modernisation of law, the concept of transition also seems to be the privileged place of occurrence for such dynamics. This group of Italian and Brazilian scholars contributing to this volume intends to investigate such problems through an interdisciplinary prism. It includes points of view both internal to legal studies - such as the history of law, theory of law, constitutional law, private law and commercial law - and external, such as political philosophy and history of justice and political institutions.

Post War Architecture Between Italy And The Uk written by Lorenzo Ciccarelli and has been published by UCL Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2021-10-14 with Architecture categories.

Italy and the UK experienced a radical re-organisation of urban space following the devastation of many towns and cities in the Second World War. The need to rebuild led to an intellectual and cultural exchange between a wave of talented architects, urbanists and architectural historians in the two countries. Post-war Architecture Between Italy and the UK studies this exchange, exploring how the connections and mutual influences contributed to the formation of a distinctive stance towards Internationalism, notwithstanding the countries’ contrasting geographic and climatic conditions, levels of economic and industrial development, and social structures. Topics discussed in the volume include the influence of Italian historic town centres on British modernist and Brutalist architectural approaches to the design of housing and university campuses as public spaces; post-war planning concepts such as the precinct; the tensions between British critics and Italian architects that paved the way for British postmodernism; and the role of architectural education as a melting pot of mutual influence. It draws on a wealth of archival and original materials to present insights into the personal relationships, publications, exhibitions and events that provided the crucible for the dissemination of ideas and typologies across cultural borders. Offering new insights into the transcultural aspects of European architectural history in the post-war years, and its legacy, this volume is vital reading for architectural and urban historians, planners and students, as well as social historians of the European post-war period.

From Clans to Co-ops explores the social, political, and economic relations that enable the constitution of cooperatives operating on land confiscated from mafiosi in Sicily, a project that the state hails as arguably the greatest symbolic victory over the mafia in Italian history. Rakopoulos’s ethnographic focus is on access to resources, divisions of labor, ideologies of community and food, and the material changes that cooperatives bring to people’s lives in terms of kinship, work and land management. The book contributes to broader debates about cooperativism, how labor might be salvaged from market fundamentalism, and to emergent discourses about the ‘human’ economy.

Making Italian Jews written by Carlotta Ferrara degli Uberti and has been published by Springer this book supported file pdf, txt, epub, kindle and other format this book has been release on 2016-11-10 with History categories.

This book depicts the cultural imagination of the Italian-Jewish minority from the unification of the country to the end of the First World War. The creation of an Italian nation-state introduced new problems and new opportunities for its citizens. What did it mean for the Jewish minority? How could members of the minority combine and redefine Jewishness and Italianness in a radically new political and legal framework? Key concepts such as family, religion, nation, assimilation and – later – Zionism are observed as they shift and change over time. The interaction between the public and private spheres plays a pivotal role in the analysis, and the self-fashioning of Italian Jewish élites is read alongside the evolution of the cultural stereotypes typical of the time. Reinterpreting the Italian national patriotic narrative through the eyes of the Jews, Carlotta Ferrara degli Uberti is able to unveil its less known layers and articulations, while at the same time offering a new perspective from which to read the modern Jewish experience in the Western World.
